It M. CONDITIONAL USE PERMIT #1159 Page 2 CONDITIONS HOURS OF OPERATION: 1. Operations, excluding blasting, may begin at 6:00 a.m. Monday - Saturday. 2. Blasting may begin at 7:00 a.m. Monday - Saturday. 3. Drilling, blasting and crushing shall cease at 7:00 p.m. Monday - Friday and at 12:00 noon on Saturday. AREA: The North line of the conditional use permit area shall be in-line with the South right-of-way line of Sandy Lee Lane. BLASTING: Blasting will be done in accordance with the applicable restrictions contained in the Wisconsin Administrative Code regulations. When blasting, seismographic readings will he maintained below 0.40 in./sec. The seismograph will be located at various positions around the perimeter of the quarry property. This level is 20% below the ceiling allowed by the Wisconsin Administrative Code for blasting activities. When blasting is to be done, the neighbors will be notified in writing no less than eighteen hours in advance of the proposed blasting operation. Madison Crushing will notify those neighbors who which to be notified on Felland Road, from 5152 Felland Road to Burke Road, on Burke Road from Felland Road to Reiner Road, on Reiner Road from Burke Road to 5107 Reiner Road and all homes on Sandy Lee Lane. Seismograph records will be filed with the Town within seven (7) working days. BERMS: Berm along Reiner Road is to be no less than seven feet high from the Reiner Road center line elevation with 3 to 1 slope on Reiner Road side. The berm to be constructed 40 feet from the center line of Reiner Road. This berm is to be completed in the Spring of 1990 on the permitted area along Reiner Road. Madison Crushing will also assist the Town of Burke to clean up the ditch line the full length of the quarry operation. (The existing trees will be left for dust control until the new planting have grown) . A seeded berm will be built westerly along the North line of the subject area not less than four feet in height, as stripping material becomes available, but not later than the Fall of 1990. except the Westerly 900 ' , more or less, of the South property line, FENCING: The entire quarryflwill be enclosed by a woven wire fence located one foot inside the property line and a locked gate at the North entrance. The fence along Reiner Road and the North line of the C.U.P. will be installed in the Spring of 1990, the entire quarry will be fenced by the Fall of 1990. THE ENTRANCE ROAD- The entrance road down into the quarry will be oiled with emulsified road oil to control dust at all times. RECLAMATION: When the quarry has been depleted, or within twelve (12) months of the expiration of the Conditional Use Permit, which ever comes first, Madison Crushing will slope the banks to not steeper than a one to one slope, and will cover the flat areas with at least one foot of tillable soil. Applicant shall comply with all municipal, state and federal laws and regulations pertaining to reclamation procedures and air and noise pollution measured at the perimeter of the mineral extraction operation during the term of this permit.
