j <br /> DANE COUNTY Page 1 of 2 <br /> CONDITIONAL USE PERMIT #1175 <br /> THE ZONING AND NATURAL RESOURCES COMMITTEE OF THE DANE COUNTY BOARD <br /> PURSUANT TO SECTION 10.255 (2) OF THE DANE COUNTY CODE OF <br /> ORDINANCES DOES HEREBY: <br /> GRANT the conditional use permit subject to conditions, see <br /> attached. <br /> FOR: Sale of agricultural & dairy products not produced on the <br /> premises. <br /> EFFECTIVE DATE OF PERMIT: 08/23/94 EXPIRATION DATE: SEE BELOW <br /> THE CONDITIONAL USE SHALL BE LOCATED ON THE PROPERTY DESCRIBED AS <br /> FOLLOWS: <br /> Part of the NW 1/4 NW 1/4 Section 26, Town of Black Earth described <br /> as follows: Commencing at the Northwest conrer of said 1/4 1/4 <br /> thence South to the North right-of-way of USH 14, the Southeast <br /> along North right-of-way line 300 feet to the point of beginning. <br /> Thence 150 feet Northeasterly perpendicular to right-of-way; thence <br /> Southeasterly 500± feet parallel to right-of-way, thence 135 feet <br /> Southwest perpendicular to right-of-way, thence Northwesterly along <br /> right-of-way to point of beginning. <br /> THE ZONING AND NATURAL RESOURCES COMMITTEE AFTER PUBLIC HEARING AND <br /> IN THEIR CONSIDERATION OF THE CONDITIONAL USE PERMIT MADE THE <br /> FOLLOWING FINDING OF FACT: <br /> 1. That the establishment, maintenance and operation of the <br /> proposed conditional use will not be detrimental to or endanger <br /> the public health, safety, morals, comfort or general welfare. <br /> 2 . That the uses, values and enjoyment of other property in the <br /> neighborhood for purposes already permitted will not be <br /> substantially impaired or diminished by the establishment, <br /> maintenance and operation of the proposed conditional use. <br /> 3. That the establishment of the proposed conditional use will not <br /> impede the normal and orderly development and improvement of the <br /> surrounding property for uses permitted in the district. <br /> 4. That adequate utilities, access roads, drainage and other <br /> necessary site improvements will be made. <br /> 5. That adequate measures will be taken to provide ingress and <br /> egress so designed as to minimize traffic congestion in the <br /> public streets. <br /> 6. That the proposed conditional use does conform to all applicable <br /> regulations of the district in which it is proposed to be <br /> located. <br /> 7. This use will benefit the needs of either the residents or the <br /> agricultural activities in the area. <br /> 8. There are not other locations available for this use. <br /> 9. The land to be occupied by this use is not productive <br /> agricultural land. <br /> 10. Public services needed by this use are available. <br /> 11. Public services needed by this use can be furnished without <br /> becoming an unreasonable burden on the taxpayers. <br /> 12 . This use at this location will not cause significant harm to <br /> the environment. <br />
