This proposed residential rezoning appears to conflict with the agricultural <br /> preservation policies of the Town of Westport. <br /> This parcel and the adjacent subdivision existed at the time of plan adoption in 1979. The plan <br /> recognized the Riverview Garden Estates Subdivision as a development area, but did not include <br /> the parcel (Petition 6057) for additional development. The site was subsequently zoned RH-2, <br /> which allows for one house, but not more, consistent with plan policies. <br /> The most recent revision of the Town of Westport Land Use Plan also shows this site as part of <br /> the agricultural area, not a development area. <br /> The relevant policy for such a parcel is: <br /> "Existing parcels under 35 acres and non farm uses, such as individual houses, <br /> churches or businesses, are considered non-conforming parcels or uses and are <br /> permitted to continue. " <br /> Thus, the parcel is allowed the one house, not a 9-lot subdivision. <br /> The other relevant policy is: <br /> Non farm residential development by certified survey may be considered for <br /> rezoning at a density of no more than one lot per 35 contiguous acres if the <br /> rezoning meets the following criteria: <br /> a. The contiguous 35 acres must have been owned by the applicant as of the <br /> date of plan adoption. <br /> There are additional criteria; however, the key one is density. Since the parcel is less than 35 <br /> acres, policy does not allow for further division. <br /> If additional development is desired by the local unit, the plan needs to be amended to allow for <br /> unsewered residential. <br /> We note that this site is next to a limited service area (Riverview Garden Estates), which was <br /> delineated and approved as a limited service area to solve existing septic tank soil absorption <br /> system problems, but not to provide for further urban growth. <br /> Limited service areas are established to deal with specific problems, not to encourage additional <br /> development. <br /> ENVIRONMENTAL HEALTH (septic, etc.) <br /> DANE COUNTY HIGHWAY <br /> OTHER <br />
