. <br /> %. • <br /> DANE COUNTY ORDINANCE AMENDMENT NO. 6069 <br /> Amending Section 10. 03 relating to Zoning Districts in the Town of <br /> Middleton <br /> The Dane County Board of Supervisors does ordain as follows: That <br /> the Zoning District Maps of the Town of Middleton be amended to <br /> include in the LC-1 Limited Commercial District/s the following <br /> described land: <br /> Part of the W 1/2 SE 1/4 of Section 29, Town of Middleton. <br /> Commencing at the South quarter corner; thence N 88° 59 ' 07" East <br /> 735. 633 feet; thence N 00° 09 ' 44" East 283 . 01 feet to the point of <br /> beginning; thence continue N 00° 09 ' 44" East 50. 00 feet; thence N <br /> 88° 59 ' 07" East 100. 00 feet; thence N 00° 09 ' 44" East 200. 00 <br /> feet; thence S 88° 59 ' 07" West 100. 00 feet; thence N 00° 09 ' 44" <br /> Easst 962 .29 feet to the North line of the East 20 acres of the <br /> South 45 acres of the W 1/2 SE 1/4; thence N 89° 11 ' 12" East 290 <br /> feet along said North line, thence S 00° 09 ' 44" West 1211. 28 feet; <br /> thence S 88° 59 ' 07" West 290 feet to the point of beginning. <br /> CONDITIONAL ZONING <br /> Conditional zoning is hereby imposed pursuant to Section 10. 255 <br /> (3) (a) 2 . (b) of the Dane County Code of Ordinances. The rezoned <br /> area shall be subject to the following conditions. <br /> DEED RESTRICTION REQUIRED <br /> This amendment will be effective, if within 90 days of its adoption <br /> by Dane County the owner or owners of the land shall record the <br /> following restrictions on said land: <br /> (A) Use of the property shall be limited to the following: <br /> 1. General, mechanical and landscape contracting businesses <br /> and buildings used in connection with such activity. <br /> 2 . Storage of construction equipment necessary for the <br /> operation of a general, mechanical or landscape <br /> contracting business limited to a maximum of 12 pieces of <br /> equipment which may be stored in the total LC-1 zoned <br /> area comprised of this rezone and the adjacent existing <br /> 200 ' X 100 ' LC-1 area. <br /> 3 . Outside storage of materials and supplies used by a <br /> contractor in fulfilling contracts and not offered for <br /> sale to a user or consumer. <br /> 4 . A single family residence for an owner or caretaker of <br /> the business. <br /> Said restrictions shall run in favor of Dane County and the <br /> pertinent Town Board as well as the owners of land within 300 feet <br /> of the site. Failure to record the restrictions will cause the <br /> rezone to be null and void. <br /> EFFECTIVE DATE: 4 3— <br /> (ZNRPH.REZ) <br />
