Bowman • 608/266-426G <br /> 4417 Rocky Dell Road <br /> Cross Plains, WI. 53528 <br /> RE: Zoning Petition # 6090 <br /> Dear Mr. Bowman: <br /> This letter is being prepared in response to your letter dated <br /> April 12 , 1995 in which you addressed several issues pertaining to <br /> your current zoning petition # 6090. I have reviewed your letter <br /> with respect to the applicable provisions of the Dane County Zoning <br /> Ordinance. A common term that has been utilized in your <br /> correspondence is the word "authorizes" which is not specified in <br /> any of the narrative portions of the zoning ordinance which you <br /> have identified. The term frequently used in section 10. 123 (9) (b) <br /> of the ordinance is the word "comply" . This specifically indicates <br /> that substandard parcels in this zoning district shall comply with <br /> the standards of section 10. 05 (4) , the standards referenced are <br /> dimensional standards including but not limited to parcel size and <br /> setbacks. <br /> This by no means references or authorizes a change in the zoning <br /> district, a change in zoning is accomplished through the <br /> legislative process and is authorized pursuant to Section 59 . 97 of <br /> the Wisconsin State Statute. Provisions 10 . 123 (9) (b) and 10. 16 (3) <br /> of the ordinance allow for continued use under the existing zoning <br /> even though the dimensional standards of that zoning district are <br /> not being met. Section 10. 123 (9) (b) simply states the substandard <br /> parcels not complying shall meet (comply) the minimum requirements <br /> (dimensional standards) of the R-1 district. This section does <br /> authorize residential use but does not and cannot change the <br /> classification of a zoning district pursuant to State Statute. <br /> Your letter addressed the issue on how you may appeal my response <br /> if you are not in agreement.
