At this time your parcel of 28 acres became a substandard parcel due to the <br /> fact that A-1 Exclusive requires a parcel to be 35 acres to be conforming. As a result of <br /> the blanket rezoning of the Town of Cross Plains to the A-1 E it can be assumed that <br /> other substandard parcels exist in the Town of Cross Plains. Other towns in the county <br /> have also rezoned in a similar fashion however other towns have amended their plans to <br /> reflect changes since initial adoption. <br /> As stated in my previous correspondence sections 10.123(9)(b) and 10.16(3) of the Dane <br /> County Zoning Ordinance allow for continued use under the existing zoning classification <br /> even though the dimensional standards of that zoning zoning district are not being met.. <br /> Relative to your reference of section 10.123 (1) (b) and the provision of productive <br /> farmland this also is an issue where your lands may not fall into this catergory however as <br /> a result of the blanket zoning your parcel was zoned as A-1 E. As previously indicated <br /> there is nothing within the ordinance that can change the zoning of your land no matter <br /> how incompatible you may think it is with the A-1 E zoning district. The only mechanism <br /> is through legislative process as prescribed in section 59.97 of the Wisconsin State <br /> Statutes. <br /> Relative to section 10.28 of the Dane County Zoning Ordinance this section provides a <br /> clause where the narrative provisions of all county ordinances in affect at this time which <br /> are in conflict with the terms of this ordinance are repealed or voided. This is with respect <br /> to narrative provisions in other ordinances that may be in some cases less restrictive or <br /> may relate to out dated State Administrative Codes and/or Wisconsin State Statutes. This <br /> provision by no means is intended to imply the repealing of zoning districts or the zoning <br /> classification on a given parcel_of land. This can again only be accomplished through the <br /> legislative process as provided for in the statutes. <br />
