Bowman Zoning
608/266-4266
4417 Rocky Dell Road
Cross Plains, WI. 53528
RE: Zoning Petition # 6090
Dear Mr. Bowman:
This letter is being prepared in response to your letter dated
April 12, 1995 in which you addressed several issues pertaining to
your current zoning petition # 6090. I have reviewed your letter
with respect to the applicable provisions of the Dane County Zoning
Ordinance. A common term that has been utilized in your
correspondence is the word "authorizes" which is not specified in
any of the narrative portions of the zoning ordinance which you
have identified. The term frequently used in section 10. 123 (9) (b)
of the ordinance is the word "comply" . This specifically indicates
that substandard parcels in this zoning district shall comply with
the standards of section 10. 05 (4) , the standards referenced are
dimensional standards including but not limited to parcel size and
setbacks.
This by no means references or authorizes a change in the zoning
district, a change in zoning is accomplished through the
legislative process and is authorized pursuant to Section 59 . 97 of
the Wisconsin State Statute. Provisions 10. 123 (9) (b) and 10. 16 (3)
of the ordinance allow for continued use under the existing zoning
even though the dimensional standards of that zoning district are
not being met. Section 10. 123 (9) (b) simply states the substandard
parcels not complying shall meet (comply) the minimum requirements
(dimensional standards) of the R-1 district. This section does
authorize residential use but does not and cannot change the
classification of a zoning district pursuant to State Statute.
Your letter addressed the issue on how you may appeal my response
if you are not in agreement. An appeal may be filed with the Dane
