June 8, 1993 <br /> 6633 Greenbriar Rd. <br /> Middleton, WI 53562 <br /> Dear Springfield Board Members: <br /> We are asking for denial of the Conditional Use Permit of Payne &Dolan,Inc. on behalf <br /> of Yahara Materials Inc. We are in a residential setting and have spent substantial investment in <br /> an area obviously zoned for growing residential and continuing agricultural use. The <br /> surrounding 62 homes spend substantial tax dollars (personally nearly $9,000 annually) in real <br /> estate taxes to have the privilege of living in this environment. We accept that as a cost of living <br /> in this environment. We do not accept that as a cost to live next door to an asphalt plant. <br /> The organization Payne&Dolan, Inc. is acting on behalf of is Yahara Material Inc. who <br /> has shown to be an irresponsible neighbor causing numerous damage incidents to homes over <br /> their history as a quarry in the area. Since attending the Springfield Planning Commission <br /> meeting on Monday, June 7, it became very obvious that the Springfield Board was not aware of <br /> the problems involving Yahara Materials Inc. and because of their participation in this project, <br /> we feel it's vital that you become advised of the facts. The following is just an example of one <br /> situation. <br /> On Monday , April 17, 1989, The quarry blasted and anyone at home that day described <br /> it as a earthquake. I notified Yahara Materials and told them of the experience and told them our <br /> home was damaged. On Friday, April 21, 1989, there was another blast and I felt it was <br /> necessary to contact the local authorities for help. I called the Dane County Sheriffs Dept., <br /> incident report number 21406, and was told to contact the Department of Industry,Labor, and <br /> Human Relations for assistance. I contacted Mr. Gordon Helmeid, Bureau Director, and filed a <br /> claim. Quoting from a report dated 5/10/89 form the Department of Industry, Labor and Human <br /> Relations (DIHLR), <br /> "In additon to monitoring ground vibration, the Spitz residence <br /> was briefly examined to view the structural damage reported in the complaint. <br /> During that examination, Mrs. Spitz pointed out several areas in which gaps were <br /> visible between timber members of the structural framework, as well as one cracked <br /> window. Present during that examination were Mr. Burcalow of Yahara Materials, <br /> and Mr. Ahlgrimm, of Ahlgrimm Explosives Company. As a result of the exami- <br /> nation, Yahara Materials has agreed to notify their insurance carrier, and request <br /> they also examine the Spitz residence." <br /> On June 19, 1989 almost two months later we heard from Yahara Material's insurance company <br /> informing us they felt the responsibility was the blasting company's which was Alhgrim <br /> Explosives.
