AND BARRY MILLER, 3941 <br /> STH 19, TOWN OF BURKE <br /> Dear Mr. Gunderman: <br /> The above referenced rezoning application scheduled for public hearing by the <br /> Dane County Zoning and Natural Resources Committee on July 13, 1993, seeks to <br /> rezone approximately 2.2 acres from County A-1 - Agriculture district to County <br /> R-1 - Residential district to "buffer commercial development. " The proposed <br /> rezoning is within the City of Sun Prairie Extraterritorial Plat Jurisdiction <br /> and is across State Hwy. 19 from the area governed by the City of Sun Prai- <br /> rie/Town of Windsor Extraterritorial Zoning Ordinance effective July 1, 1993. <br /> The City of Sun Prairie is opposed this request based on the following con- <br /> cerns: <br /> 1. The property along the north side of State Hwy. 19 is under the jurisdic- <br /> tion of the City of Sun Prairie/Town of Windsor Extraterritorial Zoning <br /> Ordinance. No commercial zoning exists along State Hwy. 19 across from <br /> the subject property (see attached Exhibit A) . As a result, the "proposed <br /> use" statement reflected on the application is even more questionable. <br /> Approval of this request would set a precedent for residential zoning <br /> along State Hwy. 19 which would undermine the desire for agricultural land <br /> uses to the north as reflected by the current zoning. <br /> 2. It would appear that there is no benefit to rezoning the two existing <br /> residences to R-1 Residential other than the ability to require a 100 foot <br /> setback for any new additions to the kennel located to the south of the <br /> subject site. We believe reasonable conditions could be placed on any <br /> kennel expansions so as not to negatively impact adjoining land uses re- <br /> gardless of zoning. <br /> 3. The subject property is located within an area designated as a Rural <br /> Development Area on the City of Sun Prairie's ETJ Policy Map. The pro- <br /> posed rezoning is not consistent with this document in that it encourag- <br /> es additional unserviced residential development at non-rural densi- <br /> ties. The Rural Development Areas are so established to preserve agricul- <br /> tural lands and to plan for the timing of development of such lands upon <br /> the availability of urban services and sewer and water to accommodate <br /> development.
