ORDINANCE AMENDMENT NO. 5698 <br /> Amending Section 10.03 relating to Zoning Districts in the Town of <br /> WESTPORT <br /> The Dane County Board of Supervisors does ordain as follows: That the <br /> Zoning District Maps of the Town of Westport be amended to include in the C-2 <br /> Commercial District the following described land: <br /> Part of the NE 1/4 SE 1/4 Section 30, Town of Westport described as follows: <br /> Commencing at the Southeast corner of said NE 1/4 SE 1/4; thence S 89° 40' 48" <br /> West, 203.13 feet to the point of beginning. Thence continue S 89° 40 ' 48" <br /> West, 135.23 feet; thence N 00° 55' 52" West, 322.00 feet; thence N 89° 40'48" <br /> East, 338.41 feet; thence S 00° 55' 52" East, 161 .00 feet; thence S 89° 40 ' 48" <br /> West, 203.13 feet; thence S 00° 55' 52" East, 161 .00 feet to the point of <br /> beginning. <br /> CONDITIONAL ZONING <br /> Conditional zoning is hereby imposed pursuant to Section 10.255 (3) (a) 2. (b ) <br /> of the Dane County Code of Ordinances . The rezoned area shall be subject to <br /> the following restrictions and conditions. <br /> DEED RESTRICTION REQUIRED <br /> This amendment will be effective, if within 90 days of its adoption by Dane <br /> County the owner or owners of the land shall record the following restrictions <br /> on said land: <br /> 1 . Use of the property shall be limited to the owner 's residence, a <br /> trucking business home office and storage and maintenance of a maximum <br /> of 6 dump trucks. <br /> 2. Outside storage of business items , materials or equipment is not <br /> permitted. <br /> 3. Screening, subject to the approval of the Town Board, shall be installed <br /> and maintained in good condition. <br /> Said restrictions shall run in favor of Dane County and the pertinent Town <br /> Board as well as the owners of the land. Failure to record the restrictions <br /> will cause the rezone to be null and void. <br /> CONDITIONS <br /> 1 . This amendment shall be effective as of the date that both of the <br /> following requirements have been accomplished: <br /> a. Installation of appropriate screening subject to the approval of the <br /> Town Board. <br /> b. Execution of an agreement with the Town of Westport which stipulates <br /> that an application to rezone the property to single family <br /> residence use shall be filed when the current trucki.ng`operation <br /> ceases or the property is sold. <br /> EFFECTIVE DA ' : q !- A <br /> 1 <br />
