DEAL n► 9-23-93 ; 1 :54PM ; JENSWOLD, STUDT, . . .-DANE CO TREASURER ;# 5/ 6 <br /> (c) Said catering business shall not employ more than 2 persons who are not <br /> family members of owners' family. <br /> (d) There shall be no overnight outdoor storage of vehicles or equipment used in <br /> the conduct of said business. <br /> (e) There shall be no signage related to the business. <br /> 2. Use of Public Right-of-way: Owners may utilize the public right of way of Windsor <br /> Street abutting the above described property for the location of a paved private driveway provided <br /> that a Public Right of Way Use Agreement is executed with the Town of Windsor. Owners hereby <br /> agree that any improvements, including landscaping, located in the right of way are placed at the <br /> sufferance of the Town of Windsor and must be removed at owners' cost upon due notice from the <br /> Town. Owners also agree to waive any right to object to any improvement of Windsor Street by <br /> the Town of Windsor, <br /> 3. Hold Harmless & Indemnification: Owners hereby indemnify and hold harmless the <br /> Town, its officers, agents and employees, past, present, and future, from any claims arising from <br /> these restrictions, <br /> 4. Enforcement: The covenants and restrictions provided herein shall be enforceable at <br /> law or equity against any party who has or acquires an interest in the land subject to the covenants <br /> and restrictions by the following parties for whose benefit these covenants and restrictions are <br /> declared: <br /> (a) The County of Dane County, Wisconsin, provided that the lands are <br /> under the jurisdiction of a zoning ordinance of said County at the time <br /> the enforcement action is commenced; and <br /> (b) The Town of Windsor, Dane County, Wisconsin, provided that the lands <br /> are within the governmental jurisdiction of said Town at the time the <br /> enforcement action is commenced. <br /> 5. Amendment: The restrictions set forth herein may be amended only after the <br /> owner(s) at the time of filing files a written petition with the Dane County Clerk and the Windsor <br /> Town Clerk seeking amendment of the restrictions. Each clerk shall refer the petition to its <br /> commission or committee having jurisdiction over zoning matters which shall schedule and hold a <br /> public hearing in the same mariner as other zoning matters. Each body shall issue a written report <br /> on the petition prior to the petition's submission to the Dane County Board of Supervisors and the <br /> Windsor Town Board. Unless each governing body approves the petition, the amendment shall not <br /> be recorded by the owner(s). <br /> 6. Termination, Effect: The restrictions set forth herein may be terminated only after <br /> approval of a petition for termination following the same procedure as the petition for amendment <br /> set forth in paragraph 5. The Windsor Town Board and its committee responsible for zoning <br /> matters shall consider the goals and objectives of the Windsor Comprehensive Plan in reviewing- <br /> said petition. <br />
