Prior to <br /> purchasing the property, the Russos inquired of Dane County <br /> Zoning as to the legality of the proposed use. <br /> Attachment No. 4 is a report issued on June 9, 1987, over <br /> the signature of Patrick D. Anderson of the Dane County Zoning <br /> office. Please note that Mr. Anderson wrote, "A temporary <br /> building for a caretaker is permitted provided it is a temporary <br /> building. " Mr. Anderson did not indicate that a conditional use <br /> approval was required. The Russos relied upon what was written <br /> by Mr. Anderson. They did not have a lawyer at the time. They <br /> were moving to Dane County and were not intimately familiar with <br /> the ordinances. That is why they asked the zoning office to <br /> indicate the applicable requirements. Based upon the statements <br /> from Mr. Anderson, they established a caretaker's residence in a <br /> purchased mobile home connected to a new septic system and well. <br /> The residence has been occupied for over five years. The need <br /> for conditional use approval was identified lately and this <br /> application was then prepared. <br /> We will submit photographs showing the portions of the site <br /> and the caretaker's residence pertinent to this application as a <br /> supplement to this application. <br /> The mobile home is occupied around the clock as a combina- <br /> tion office and living quarters for the night time staff (a <br /> single individual) . We want to stress that the occupancy by the <br /> caretaker is an essential part of the business. This is not a <br /> case of somebody who wants to sleep at their place of business <br /> simply as a matter of convenience or cost savings. We want to <br /> stress that the utilities (septic system, etc. ) were necessary <br /> for the office to operate. Installation of those systems was not <br /> predicated upon the caretaker's residence. <br /> Although the ordinance and the application form do not <br /> specifically require it, we have indicated on the site plan the <br /> portions of the site that we consider part of the caretaker's <br /> residence. These include the location of the trailer and <br /> appertenances, the storage and parking for the business and the <br /> caretaker's residence (as differentiated from the rented vehicu- <br /> lar and related storage that occurs on the remainder of the <br /> site) , and a dog kennel that holds kennel license No. 17328- <br />
