August 3, 1993 <br /> To: Members, Town of Perry Land Use Committee <br /> From: Residents & Property Owners, Town of Perry <br /> RE: Zoning Petition# 5719: Application by Louis H. Heitke to change <br /> zoning from A-1 Exclusive Agricultural to RH-3 Rural Homes. <br /> Location: South of 242 Drammen Valley Road, Section 31, W 1/2 NE <br /> and SE NW. <br /> We, the undersigned persons, oppose the application for rezoning the 12 acre parcel identified <br /> in the description above. As current residents of the Perry township and owners of property in the <br /> vicinity of the parcel in question, we would be adversely affected by the proposed rezoning. <br /> We have outlined below our chief reasons for opposing the application. <br /> (1) The 12 acres are in the A-1 Agricultural Exclusive District. The Perry Town Plan rule of not <br /> allowing more than one lot per 35 acres clearly applies here and would be violated if the application were <br /> approved. (See "Agricultural Preservation Area"; Policies, item 4. h.). <br /> (2) Waiving the 35 acre rule sets a dangerous precedent and erodes the most fundamental goal of the <br /> Plan: preservation of agricultural land in the Town of Perry. <br /> (3) The application also is incompatible with "Agricultural Preservation Area Policies", item 4. d. <br /> A building site on this parcel would "...disturb or destroy important natural features such as significant <br /> woodland areas, wetlands, springs, and steep slopes (20 percent)." The greater part of the parcel in <br /> question is a steep slope, most of which is in excess of 20 percent. In fact, much appears to exceed 30 <br /> percent. <br /> (4)The current application for rezoning also conflicts with "Agricultural Preservation Area Policies", <br /> item 2, which states that land use should "...protect existing farm operations from restrictions on noise, <br /> odor and the keeping of animals associated with farm operations." A home on the 12 acre parcel would <br /> be surrounded on at least two sides by working farm land with agricultural and livestock operations to <br /> which occupants of that home might well object. <br /> (5) The only practical location for a dwelling on the 12 acre parcel is on Berg Road, the remainder <br /> of the parcel being too hilly or inaccessible from Drammen Valley Rd. A home at this location would <br /> be directly adjacent to and visible from the two homes already located at this intersection. The current <br /> application does not propose location of a house or a septic. The limited choices of sites on the parcel <br /> and the proximity of the most accessible site to existing farm buildings and residences raises questions <br /> about feasibility of both house and septic sites. <br /> (6) The application as written describes the overall property as a "107-acre farm." In fact, Dr. <br /> Heitke has accepted an offer to purchase 18 acres (closing date 8/11/93), reducing the overall remaining <br /> acreage to 89. <br /> We appreciate the thought that has gone into the Town of Perry's Land Use Plan and are in firm <br /> agreement with its fundamental goal. Many of us chose to live in this area in part because of the Town's <br /> sincere commitment to preserving agricultural land. We hope that commitment will be reflected in your <br /> decision concerning this rezoning application. <br />
