ADDENDUM TO OFFER <br /> BUYER: Kenneth L. Johnson and Ruth-Ann Johnson <br /> SELLER: William Aeschlimann and Shirley Aeschlimann <br /> DATE: July 26, 1993 <br /> PROPERTY: Part of 4473 Blue Mounds Trail, Town of Vermont, Dane County, Wisconsin <br /> The terms set forth in this Addendum to Offer are made part of and are included in the <br /> Vacant Land Offer to Purchase, to which this Addendum is attached: <br /> 1. Property. The property which is the subject of this Offer is as follows: <br /> A parcel consisting of approximately 22.5 acres,located in the southeastern <br /> quarter of Section 4, in the Town of Vermont, Dane County, Wisconsin, <br /> generally as highlighted in yellow, on the map attached hereto as Exhibit A. <br /> The legal description of the property shall be determined by the survey <br /> described in paragraph 2 below. <br /> 2. Contingencies. <br /> a. Survey. This Offer is contingent upon the results of a survey of the subject <br /> property indicating that: (i) the subject property is free from encroachments (either way), <br /> (ii) the subject property consists of the parcel identified on Exhibit A and contains <br /> approximately 22.5 acres; (iii) that there are no easements, water courses, drains, sewers, <br /> roads or other questions of survey that would prevent the Buyers from constructing a single <br /> family residence on the subject property in the location they desire or prevent the title <br /> insurance company from eliminating the survey exception on the owner's title insurance <br /> policy issued with respect to this transaction. The Buyer shall be responsible for the cost <br /> of and for obtaining the survey. If this contingency is not removed by the Buyer, in writing, <br /> on or before 30 days from the date of acceptance of this Offer, this Offer shall be null and <br /> void. <br /> b. Septic Soils Test. This Offer is contingent upon the results of a percolation <br /> test report by a certified soil tester indicating that the soils, at appropriate locations on the <br /> property, meet present standards to obtain a permit for the installation of a private septic <br /> system. The buyer shall be responsible for the cost of and for obtaining the test. If this <br /> contingency is not removed by the Buyer, in writing, on or before 30 days from the date of <br /> acceptance of this Offer, this Offer shall be null and void. <br /> c. Availability of Well. This Offer is contingent upon the Buyer obtaining a test <br /> result from a qualified plumbing company or other appropriate tester indicating that at <br /> appropriate locations on the property, a well to provide an adequate supply and quality of <br />
