Effective March 29, 2016 <br /> Dane County Board of Supervisors <br /> Amending Chapter 10 of the Dane County Code of Ordinances <br /> Zoning Map Amendment Petition 10930 <br /> Dane County Board of Supervisors does ordain as follows: <br /> The Zoning Districts Maps as referenced under Dane County Code of Ordinance Section 10.03 <br /> shall be amended as follows: <br /> Town Map: Town of Middleton Location: Section 18 <br /> Zoning District Boundary Changes <br /> RH-1 TO A-1 <br /> Part of Lot 1, Certified Survey Map No. 4973, recorded in Volume 22 of Certified Survey Maps on pages <br /> 140-142 as Document Number 1945813, Dane County Registry, located in the NW1/4 of the SW1/4 of <br /> Section 18,T7N,R8E,Town of Middleton,Dane County, Wisconsin to-wit: Commencing at the <br /> Southwest corner of said Section 18;thence N00°01'53"W, 2016.61 feet along the West line of said <br /> SW 1/4;thence S88°32'08"E, 33.01 feet to a point on the East right-of-way line of Timber lane, also being <br /> the point of beginning;thence continuing S88°32'08"E, 425.67 feet;thence S00°05'12"W, 267.29 feet to a <br /> point on the North line of Lot 3, of said Certified Survey Map No. 4973; thence N89°29'33"W, 274.99 <br /> feet along said North line and to the Northwest corner of said Lot 3; thence S00°0 1'10"E, 194.72 feet <br /> along the West line and to the Southwest corner of said Lot 3, also being on the North right-of-way line of <br /> Windermere Court; thence N88°35'48"W, 150.00 feet along said North right-of-way line to a point on the <br /> East right-of-way line of Timber Lane;thence N00°01'53"W,466.77 feet along said East right-of-way <br /> line to the point of beginning. Containing 144,205 square feet(3.311 acres). <br /> CONDITIONAL ZONING <br /> Conditional zoning is hereby imposed pursuant to Section 10.255(3)(a)2.(b) of the Dane County <br /> Code of Ordinances. The rezoned area shall be subject to the following conditions. <br /> 1. The parcel shall be divided into 2 lots; one being 1.8 acres and one being 1.5 acres. <br /> 2. A site plan shall be reviewed and approved by the Town Board prior to the development of <br /> Lot 2. <br /> CERTIFIED SURVEY REQUIRED <br /> The above listed description/s is/are intended to describe land for which a certified survey map will <br /> be prepared for approval and recorded. Within 90 days of rezoning approval by Dane County, a <br /> final certified survey map that describes the land to be rezoned shall be prepared in accordance <br /> with all applicable provisions of Chapter 236 Wisconsin Statutes and Chapter 75 Dane County <br /> Code of Ordinances, and submitted to the Dane County Zoning Division. Upon submission of the <br /> final certified survey map, the Zoning and Land Regulation Committee, or its authorized <br /> representative, shall, within 30 days, approve, approve conditionally, or reject the certified survey <br /> map. Failure to submit the final certified survey within the 90 day period and/or failure to <br /> record the survey with the Dane County Register of Deeds will cause the rezone to be null <br /> and void. Two copies of the recorded survey shall be submitted to Dane County Zoning. <br />
