/ <br /> 7 . Default. Buyer agrees that time is of the essence as <br /> to this contract and that in the event of default in payment of <br /> any principal due under this contract, the then entire <br /> outstanding balance of this contract shall become immediately due <br /> and payable in full and interest shall accrue at the rate of 11%, <br /> at Seller 's option. Seller also shall have the right or option <br /> to terminate this Contract and recover the property back through <br /> strict foreclosure with any equity of redemption to be <br /> conditioned upon Buyer ' s full payment of the entire outstanding <br /> balance, with interest thereon from the date of default at the <br /> rate of 11%, and other amounts due hereunder, or Seller may sue <br /> for specific performance of this Contract or 'compel the immediate <br /> and full payment of the entire outstanding balance with interest <br /> thereon at the rate of 11%, and other amounts due hereunder, in <br /> which event the property shall be auctioned at judicial sale and <br /> Buyer shall be liable for any deficiency or Vendor may sue for <br /> the entire unpaid purchase price or any portion thereof, or <br /> Seller may declare this Contract at an end and remove this <br /> Contract as a cloud on title and quiet title action, <br /> notwithstanding any of the above, an election of the foregoing <br /> remedies shall only be binding upon Seller if and when pursued in <br /> litigation and all costs and expenses, including reasonable <br /> attorneys ' fees of the Seller, incurred to enforce any remedy <br /> hereunder, whether abated or not, to the extent not prohibited by <br /> law and the expenses of title evidence shall be added to the <br /> principal unpaid by the Buyer, as incurred, and shall be included <br /> in any judgment. <br /> Seller may waive any default without waiving any other <br /> subsequent or prior default of the Buyer. <br /> 8 . Notice.
