• <br /> • <br /> ` DANE COUNTY ORDINANCE AMENDMENT NO. 5801 <br /> Amending Section 10. 03 relating to Zoning Districts in the Town of <br /> BERRY <br /> The Dane County Board of Supervisors does ordain as follows: That <br /> the Zoning District Maps of the Town of Berry be amended to include <br /> in the RH-2 and RH-3 Rural Homes District the following described <br /> land: <br /> Pet. #5801: <br /> Part of the NW 1/4 NE 1/4 and SE 1/4 NW 1/4 Section 16, Town of <br /> Berry described as follows: TO RH-2 : Commencing at the North <br /> quarter corner of said Section 16; thence East, 300 feet to the <br /> point of beginning; thence North along the East right-of-way of CTH <br /> KP, 33 feet; thence East 600 feet parallel to the North line of <br /> said Section 16; thence South 400 feet; thence N 87° West, 660 <br /> feet; thence N 08° East along said highway, 400 feet to the point <br /> of beginning. TO RH-3 : Commencing at the North quarter corner of <br /> said Section 16; thence South along the West line of said 1/4 1/4, <br /> 1319 . 8 feet to the point of beginning; thence East along the South <br /> line of said 1/4 1/4, 1200 feet; thence North 400 feet; thence West <br /> 1100 feet; thence S 13° West along the centerline of CTH KP, 410 <br /> feet to the point of beginning. Also, that part of the SE 1/4 NW <br /> 1/4 Section 16, Town of Berry described as follows: That part of <br /> the SE 1/4 NW 1/4 Section 16, lying Westerly of CTH KP and South of <br /> Far View Road. <br /> CONDITIONAL ZONING <br /> Conditional zoning is hereby imposed pursuant to Section 10. 255 <br /> (3) (a) 2 . (b) of the Dane County Code of Ordinances. The rezoned <br /> area shall be subject to the following conditions. <br /> CERTIFIED SURVEY REQUIRED <br /> The above listed description/s is/are intended to describe land for <br /> which a certified survey map will be prepared for approval and <br /> recorded. This amendment will become effective, if within 90 days <br /> of its approval by Dane County, a certified survey map that <br /> describes the land to be rezoned is recorded in the office of the <br /> Dane County Register of Deeds. Failure to record the survey will <br /> cause the rezone to be null and void. <br /> DELAYED EFFECTIVE DATE <br /> The rezone for parcels that have their driveway access located on <br /> CTH "K" will be effective upon issuance of a County Highway permit <br /> for said access. <br /> /1/1)4e4 <br /> EFFECTIVE DATE: APR 2 s ! 4 <br />
