DANE COUNTY ORDINANCE AMENDMENT NO. 5821 . . <br /> Amending Section 10. 03 relating to Zoning Districts in the Town of <br /> RUTLAND <br /> The Dane County Board of Supervisors does ordain as follows: That <br /> the Zoning District Maps of the Town of be amended to include in <br /> the RH-4 Rural Homes District the following described land: <br /> Pet. #5821: <br /> Part of the NE 1/4 NE 1/4 of Section 29, part of the SE 1/4 SE 1/4 <br /> of Section 20, and part of the SW 1/4 SE 1/4 of Section 20, Town of <br /> Rutland described as follows: <br /> TO RH-4: Beginning at the Northeast corner of said Section <br /> 29; thence Southerly along the East line of said NE 1/4 NE 1/4; 329 <br /> feet ±; thence S 87° 19 ' 39" West, along a line 329 feet ± South of <br /> and parallel to the North line of said NE 1/4 NE 1/4 ; 1323 feet ± <br /> to the West line of said NE 1/4 NE 1/4; thence Northerly, along <br /> said West line, 329 feet ± to the North line of said NE 1/4 NE 1/4; <br /> thence S 87° 19 ' 39" West, along the South line of said SE 1/4 of <br /> Section 20, 559. 26 feet; thence N 00° 05 ' 41" West, along said West <br /> line, 693 . 64 feet; thence N 89° 26 ' 43" East, 732 . 03 feet; thence <br /> N 00° 01 ' 20 ' East, 632 . 42 feet to the North line of said SE 1/4 SE <br /> 1/4; thence N 87° 26 ' 43" East, along the North line of said SE 1/4 <br /> SE 1/4; 1151. 05 feet to the Northeast corner of said SE 1/4 SE 1/4 ; <br /> thence South, along the East line of said SE 1/4 SE 1/4 , 1322 . 24 <br /> feet to the point of beginning. <br /> CONDITIONAL ZONING <br /> Conditional zoning is hereby imposed pursuant to Section 10. 255 <br /> (3) (a) 2 . (b) of the Dane County Code of Ordinances. The rezoned <br /> area shall be subject to the following conditions. <br /> DEED RESTRICTION REQUIRED <br /> This amendment will be effective, if within 90 days of its adoption <br /> by Dane County the owner or owners of the land shall record the <br /> following restrictions on said land: <br /> A. No further divisions of- the property to be zoned RH-4 <br /> shall be permitted unless a new application for rezoning <br /> is approved. <br /> Said restrictions shall run in favor of Dane County and the <br /> pertinent Town Board as well as the owners of the land. Failure to <br /> record the restrictions will cause the rezone to be null and void. <br /> EFFECTIVE DATE: 23 79 <br />
