• <br /> ` DANE COUNTY ORDINANCE AMENDMENT NO. 5827 <br /> Amending Section 10. 03 relating to Zoning Districts in the Town of <br /> Westport <br /> The Dane County Board of Supervisors does ordain as follows: That <br /> the Zoning District Maps of the Town of Westport be amended to <br /> include in the R-4 Residential the following described land: <br /> Part of the NW 1/4 NW 1/4 of Section 26 and part of the SW 1/4 SW <br /> 1/4 of Section 23, Town of Westport, described as follows: <br /> Commencing at the Northwest corner of said Section 26; thence S 01° <br /> 56' West 56.80 feet; thence S 42° 17 ' East 136.20 feet to the point <br /> of beginning of this description; thence S 44° 43 ' East 175. 00 feet <br /> along the centerline of Old STH 113, (now Westport Road) ; thence N <br /> 43° 17 ' East 466.41 feet; thence N 42° 27 ' West 175.38 feet along <br /> the Southwesterly right-of-way of the Chicago and Northwestern <br /> Railroad; thence S 43° 17 ' West 473 .35 feet to the point of <br /> beginning. <br /> CONDITIONAL ZONING <br /> Conditional zoning is hereby imposed pursuant to Section 10.255 <br /> (3) (a) 2. (b) of the Dane County Code of Ordinances. The rezoned <br /> area shall be subject to the following conditions. <br /> DEED RESTRICTION REQUIRED <br /> This amendment will be effective, if within 90 days of its adoption <br /> by Dane County the owner or owners of the land shall record the <br /> following restrictions on said land: <br /> 1. Not more than 37 apartment units may be constructed. <br /> 2 . Buildings constructed on the property shall be subject to <br /> "design review" and approval by the Town. <br /> Said restrictions shall run in favor of Dane County and the <br /> pertinent Town Board as well as the owners of the land. Failure to <br /> record the restrictions will cause the rezone to be null and void. <br /> EFFECTIVE DATE: <br />
