RPC SUPPLEMENTARY COMMENTS <br /> Petition 5849 - CUP #1117 <br /> The previous comments for the public hearing noted that R-3A duplex zoning was proposed <br /> for the existing house. That wws in error. <br /> The proposal is that the main portion of the 5.5-acre parcel, including the farm buildings, <br /> would be zoned A-2 Agriculture with a Conditional Use Permit for the existing residence. <br /> A new duplex on a new lot is proposed to be rezoned R-3A. The site is in an agricultural <br /> preservation area. The relevant policy is: <br /> Non farm residential development in Agricultural Preservation areas will be <br /> restricted to land with soils not classified as prime farmland or farmland of <br /> statewide importance (as shown on maps)providing the lot is one (1) acre or more <br /> at a density of one lot per 40 acres within a farm unit and is rezoned from <br /> agriculture. <br /> With a 5.5-acre parcel, which is partially wooded and has a house and outbuildings, farmland <br /> is not the issue. However, the density of one lot per 40 acres does not allow for such a parcel <br /> to be further divided. <br /> In addition, there is no provision in the adopted town/county policies which allows for a <br /> duplex. Some plans make specific provision for duplexes; however, the Albion plan contains <br /> no provision for duplexes. <br /> At the public hearing, the applicant noted other houses in the area, which is true. There are <br /> houses on the lots to the north and south. The question is, whether to divide the lots further. <br /> Because this is an agricultural preservation area, the density policy is one lot per 40 acres, <br /> and does not allow for further division. <br /> The platted area approximately 1/8 mile north (Windwood Circle) is in the Albion <br /> Development District where adopted policy would allow low-density residential development <br /> with a minimum lot size of 30,000 square feet or 0.69 acre. <br /> We are aware that the Town of Albion is considering an amendment to their plan. If further <br /> residential development of this area can be justified, the plan could be amended to include <br /> this proposal in the Albion Development District. <br /> TLS:mp <br /> 2/11/94 <br />
