RECORDING INFORMATION <br /> AGREEMENT AND RESTRICTIONS <br /> THIS AGREEMENT entered into on April Q.S , 1994, between David <br /> A. Smith and Karen K. Smith, hereinafter called "Property Owners" <br /> and the Town of Albion, County of Dane, State of Wisconsin. <br /> 1 . David A. Smith and Karen K. Smith are the owners of <br /> property located in the Town of Albion, Dane County, Wisconsin, <br /> more particularly described as: <br /> A piece and parcel of land located in the NE 1/4 of the NE 1/4 <br /> of Section 28, in the Town of Albion, described as follows: <br /> Beginning at a point in the center of the highway on the North <br /> boundary of Section 28, which point is 64 feet West of the NE <br /> corner of said Section 28, thence South and parallel with the <br /> East line of Section 28, 22 rods, thence West and parallel <br /> with the North line of said Section 28 a distance of 152 feet <br /> to an iron stake, thence at right angles North along a line <br /> parallel to the first described line to the center of the <br /> highway, thence at right angles East along the center of the <br /> highway to the point of beginning of this description. <br /> 2 . The property is presently zoned as an A-1 District. <br /> David A. Smith and Karen K. Smith petitioned the Town Board of the <br /> Town of Albion to rezone the property from A-1 exclusive <br /> agricultural to C-1 commercial to allow a single-family residence <br /> on the same property. The applicants and their heirs, successors <br /> and assigns will limit the use of the C-1 District portion of the <br /> property to the operation of applicants ' new machine shop and <br /> residential use for the owner of the business, to the extent that <br /> such operations are permitted in the C-1 District under applicable <br /> zoning ordinances. <br />
