RESTRICTIONS <br /> I. WHEREAS, is/are <br /> the owner/s of the following described land in the Town of <br /> Dane County, Wisconsin, to-wit: <br /> Part of the SE 1/4 NW 1/4 and the SW 1/4 NW 1/4 of Section 14, Town of Dunn <br /> described as follows: <br /> TO RH-3: Commencing at the Southwest corner of said Section 14; thence <br /> North 3384. 60 feet along the West Line of said Section 14 to a point on the <br /> centerline of a town road; thence S 89° 18 ' 00" East, 1255.50 feet along said <br /> centerline to the point of beginning of this description; thence N 00° 15' 00" <br /> East, 213 . 00 feet; thence S 89° 18 ' 00 ' East 815 ± feet to a point on the West <br /> edge of the Yahara River; thence Southerly along said West edge 900 feet ± to <br /> a point on the East-West quarter line of said Section 14; thence N 89° 18 ' 00" <br /> West, 939.55 feet along said East-West quarter line; thence N 00° 15' 00' <br /> East, 692.62 feet to the point of beginning of this description. <br /> TO RH-4: Commencing at the Southwest corner of said Section 14; thence <br /> North 3384. 60 feet along the West line of said Section 14 to the point of <br /> beginning of this description; thence continuing along said West line, North <br /> 342 .02 feet; thence N 89° 00' 00" East, 1289. 10 feet; thence N 05° 56 ' 00" <br /> East, 270. 00 feet; thence N 88° 09 ' 00 ' East, 888.47 feet ± to a point on the <br /> West edge of the Yahara River; thence Southerly along said West edge 492 feet <br /> ±; thence N 89° 18 ' 00" West, 815.00 feet; thence S 00° 15 ' 00" West, 213.00 <br /> feet to a point on the centerline of a town road; thence N 89° 18 ' 00" West, <br /> 1255. 60 feet along said centerline to the point of beginning. <br /> II. WHEREAS said owner desires to place certain restrictions thereon, to bind <br /> the owner and those who may acquire title hereafter. <br /> III. NOW, THEREFORE, in consideration of the mutual benefits passing to and <br /> from the owner and those who may hereafter purchase said land and the <br /> parties named as beneficiaries of these restrictions, the following <br /> restrictions are hereby imposed: <br /> (A) Buildings or excavations within 450 feet from The Ordinary High Water <br /> Mark on the RH-4 parcel are prohibited. <br /> (B) Buildings or excavations within 350 feet from The Ordinary High Water <br /> Mark on the RH-3 parcel are prohibited. <br /> These restrictions shall constitute covenants running with the land and <br /> shall be binding upon all parties now owning any part of said land, their <br /> successors, heirs and assigns, and all parties holding under them unless, <br /> pursuant to paragraphs 5 or 6 of this instrument, said restrictions are <br /> amended or terminated. <br />
