WHEREAS, said owners desire to place certain restrictions and notice on the above-described <br /> real estate, to bind the owner(s) and those who may acquire title hereafter. <br /> WHEREAS, the restrictions provided herein shall be enforceable at law or equity against any <br /> party who has or acquires any interest in the land subject to this restriction by the following who are <br /> named as Grantees and beneficiaries with enforcement rights: <br /> • The County Government of Dane County, Wisconsin provided that the land is under the <br /> jurisdiction of said County at the time the enforcement action is commenced, and; <br /> • The Town Government of the Town of Montrose, Dane County, provided that the land is <br /> within the jurisdiction of said Town at the time the enforcement is commenced, and; <br /> • The owner(s) of record of any lands that are located within 300 feet of the subject <br /> property. <br /> THEREFORE, the following restrictions are hereby imposed: <br /> 1. Residential development of the property is prohibited. <br /> 2. Land uses on the property shall be limited to the following: <br /> a. pick your own wholesale fruit/vegetable operation. Ancillary sales of jams, jellies, juices, <br /> and pies from products grown on the property would be allowed. <br /> 3. Hours of operation: <br /> a. The hours for sales of product shall be limited to 8am to 8pm seasonally, May through <br /> November. <br /> 4. The number of employees shall be limited to no more than 4 full-time equivalent employees, in <br /> addition to the owner/operator. <br /> 5. On-site parking: <br /> a. Prior to the operation, site plan approval shall be obtained from the Montrose Town <br /> Board which will address adequate on-site parking. The site plan shall also include the <br /> proposed building size for the operation. <br /> b. Parking along Butts Road is prohibited. The landowner shall be responsible for posting <br /> "No parking" signs along Butts Road. <br /> 6. Condition of Butts Road: <br /> a. The Public Works Director shall evaluate the condition of Butts Road and determine if the <br /> roadway will support two-way traffic for the business activity.
