ORDINANCE AMENDMENT NO. 5490 <br /> Amending Section 10.03 relating to Zoning Districts in the Town of <br /> ALBION <br /> The Dane County Board of Supervisors does ordain as follows: That the <br /> Zoning District Maps of the Town of Albion be amended to include in the A-2 <br /> Agriculture District the following described land: <br /> Part of the E 1/2 NE 1/4 and NE 1/4 SE 1/4 Section 28, Town of Albion described <br /> as follows: Commencing at the Northeast corner of said Section 28; thence <br /> along the North line of said Section 28, N 89° 56' 40" West, 216 feet to the <br /> point of beginning; thence South parallel to the East line of said Section 28, <br /> S 00° 19' 40" West, 363 feet; thence West parallel to the North line of said <br /> Sectin 28, N 89° 56' 40' West, 287.44 feet; thence South parallel to the East <br /> line of said Section 28, N 89° 56' 40" West, 287.44 feet; thence South parallel <br /> to the East line of said Section 28, S 00° 19' 40" West, 2278.85 feet to the <br /> South line to the NE 1/4 of said Section 28; thence along the South line of the <br /> NE 1/4 of said Section 28, N 89° 26' 40" East, 3.63 feet; thence S 00° 26' 00" <br /> West, 195.86 feet; thence N 88° 24' 50" West, 804.91 feet; thence N 00° 14' 44" <br /> East, 165.77 feet to the South line of the NE 1/4 of said Section 28; thence <br /> continuing N 00° 14' 44" East, 2017.39 parallel to the West line of the said NE <br /> 1/4 to the South line of Lot #4, Certified Survey Map #1011; thence S 89° 56' <br /> 40" East, 140.00 feet along the South line of said Lot #4; thence N 00° 14' 44" <br /> East, 633.00 feet to the North line of said Section 28; thence East along the <br /> said North line of said Section 28, S 89° 56' 40" East, 952.94 feet to the <br /> point of beginning. <br /> CONDITIONAL ZONING <br /> Conditional zoning is hereby imposed pursuant to Section 10.255 (3)(a) 2.(b) of <br /> the Dane County Code of Ordinances. The rezoned area shall be subject to the <br /> following conditions. <br /> DEED RESTRICTION REQUIRED <br /> This amendment will be effective, if within 90 days of its adoption by Dane <br /> County the owner or owners of the land shall record the following restrictions <br /> on said land: <br /> A. Use of the property shall be limited to an airport facility which <br /> is defined as a tract of land on which aircraft can land or take <br /> off on leveled grassed or hard-surfaced landing strips and <br /> including as may be necessary an office, pilot/passenger lounge or <br /> waiting area, hangers, control tower and accommodations for <br /> freight. <br /> B. Repair of aircraft by airport personnel is not permitted. <br /> Said restrictions shall run in favor of Dane County and the pertinent Town <br /> Board as well as the owners of the land. Failure to record the restrictions <br /> will cause the rezone to be null and void. <br /> #6 <br /> EFFECTIVE DATE: <br />
