The Permit <br /> application shall be amended to cover dimmaiipmeipmmulimmormi the <br /> portion of Lots 32 and 33 of Waunakee Heights described below, and <br /> to include the following additional provisions and restrictions: <br /> a. Blasting. Blasting in the Endres Expansion, <br /> and Lots 32 and 33 <br /> of Waunakee Heights shall be completed by August 1, 1993 , and no <br /> further blasting in any of these areas shall be permitted after <br /> that date. <br /> b. Mining. Mining and excavation in the Endres <br /> Expansion shall be restricted to an area 200 feet south of the <br /> existing quarry, i.e. to the northernmost 200 feet of the Endres <br /> Expansion. As provided below, Operators may also mine rock from <br /> the rear portion of Lots 32 and 33 of Waunakee Heights to the <br /> northeast of the berm to be constructed, as shown in Exhibit B. <br /> After August 1, 1993 , no mining or rock removal, except as <br /> necessary for and incidental to reclamation activities, may be <br /> conducted on Lots 32 and 33 of Waunakee Heights,)' the Endres <br /> Expansion` - - - _ _ - - - - - - _ . - - <br /> c. Quarry Operations. No blasting, mining or <br /> excavation shall be permitted in any portion of the Endres ammidep or in any portion of the existing quarry, 30 months <br /> after the final plat for the development of Waunakee Heights, First <br /> Addition is approved by the Village Board of Waunakee; and during <br /> such time Operators shall not apply for extension of the existing <br /> quarry to any adjacent lands other than Endres arrimiiiirift Expansions. <br /> No stone or rock crushing shall be permitted to be conducted on any <br /> portion of any of such sites 42 months after such final plat <br /> approval. <br /> In the event that Lots 32 and 33 of Waunakee Heights <br /> have not been sold and further the Operator needs additional time <br /> to complete reclamation within the existing quarry, the parties <br /> hereto agree upon request of the Operator to discuss extending the <br /> time for quarry operations in order to complete the reclamation <br /> activities. Such extension of time, if mutually agreeable, will be <br /> for a period of time not to exceed six (6) months. <br /> d. Safety. During the continuation of quarry <br /> operations at any of these sites, and until reclamation of the <br /> sites is completed, Operators shall construct and maintain <br /> temporary construction fencing around the entire periphery of the <br /> quarry site. If the Ripp Expansion is not acquired, or is not <br /> mined and reclaimed, Operators shall construct and maintain a <br /> permanent eight-foot high woven wire fence along the western edge <br /> of the existing quarry. <br />
