If the well discharge piping from the batch plant supply well is not <br /> continuously pressurized, an Underwriter's Laboratory (UL) approved check <br /> valve and an air-vacuum relief valve shall be installed in the pump discharge <br /> pipe of the well near the pump. <br /> 8. Either a pump operation timing device or a direct pumpage measuring meter <br /> shall be installed on the batch plant supply well and maintained in good <br /> operating condition. Reports of the amount of monthly well pumpage (in <br /> gallons) for the well shall be made to the Department annually, in accordance <br /> with the requirements of s. 144.026 State Statutes, on forms that are provided <br /> by the Department. <br /> 9. The Department reserves the authority to require any schedule of reporting <br /> water levels within the batch plant supply well that it deems necessary. If a <br /> water level measuring device is not permanently installed in any well that the <br /> Department requires to report water levels, the Department's authority shall <br /> extend to require the well to be taken out of service until the reporting can <br /> be conducted. <br /> 10. Any well that is not used for two (2) or more years shall be abandoned <br /> according to the requirements of s. NR 112.26, Wis. Adm. Code unless a written <br /> approval is obtained from the Department for the temporary abandonment of the <br /> well. A well abandonment form must be completed and submitted to the <br /> Department within 30 days of abandoning each well. <br /> NOTICE OF APPEAL RIGHTS <br /> If you believe that you have a right to challenge this decision, you should <br /> know that Wisconsin statutes and administrative rules establish time periods <br /> within which requests to review Department decisions must be filed. For <br /> judicial review of a decision pursuant to sections 227.52 and 227.53, Stats. , <br /> you have 30 days after the decision is mailed, or otherwise served by the <br /> Department, to file your petition with the appropriate circuit court and serve <br /> the petition on the Department. Such a petition for judicial review must name <br /> the Department of Natural Resources as the respondent. <br /> To request a contested case hearing pursuant to section 227.42, Stats. , you <br /> have 30 days after the decision is mailed, or otherwise served by the <br /> Department, to serve a petition for hearing on the Secretary of the Department <br /> of Natural Resources. The filing of a request for a contested case hearing is <br /> not a prerequisite for judicial review and does not extend the 30 day period <br /> for filing a petition for judicial review. <br /> All requests for contested case hearings must be made in accordance with s. NR <br /> 2.05(2) , Wis. Adm. Code. This section of the code requires that the grounds <br /> for the petition for the hearing be identified and that the desired changes be <br /> described.
