During the public hearing on the above- <br /> referenced petition held on December 8, 1992, no questions were <br /> asked of the applicant concerning the Dane County Regional Plan <br /> Commission report suggesting that the A-2 (8) parcel be <br /> "conditionally rezoned" to not allow a house, since this could <br /> conflict with future "commercial development" . Barnes, Inc. <br /> respectfully requests that this property not be conditionally <br /> rezoned. As noted clearly in the RPC report, this parcel is <br /> planned for commercial use when it is added to the Urban Service <br /> Area. To add deed restrictions which affect title in lieu of <br /> amending the ordinance, will work a detriment to the property <br /> owner. The county is still in the midst of its planning process, <br /> and may yet change its intentions with regard to that parcel. If <br /> the county changes its plan, the property owner will be left with <br /> a deed restriction clouding its title long after the county's <br /> committees have determined what the ultimate land use ought to be. <br /> The commitment of Barnes, Inc. is not to develop this parcel <br /> with any residential housing whatever, but to preserve it in the <br /> A-2 zoning category for the purpose of servicing the C-2 parcel <br /> where the headquarters and truck parking will be located. <br />
