• <br /> • <br /> APPEALS PROCESS -- Chapter 11.02 ( 10) <br /> (B) A written Notice of Appeal must be filed with the Clerk <br /> within 14 days of the date when notice of the action of <br /> the Plan Comission appealed from is mailed to the sub- <br /> divider. <br /> • <br /> (C) The Notice of Appeal shall state the action of the Plan <br /> Commission appealed from, shall specify the reasons <br /> stated by the Plan Commission for taking such actions , <br /> shall specify the reasons why the subdivider believes <br /> said action was ' inapnropriate ; shall include an agree- <br /> ment to extend the time for acting on the preliminary <br /> plat , final plat , comprehensive development plan or <br /> certified survey, for a period of ninety (90) days <br /> from the date that notice of the action appealed from <br /> was mailed to the subdivider; and shall state the names <br /> and addresses of the owners of all properties within <br /> one-quarter ( 1/4) mile of the proposed land division <br /> or subdivision. <br /> (D) The Clerk shall file the Notice of Appeal with the <br /> Board and shall schedule the appeal for consideration <br /> by the Board at a meeting, open to the public , within <br /> forty-five (45) days of the filing of the Notice of <br /> Appeal . The Clerk shall send notice of the time <br /> scheduled for the consideration of the appeal to the <br /> subdivider and to all property owners adjacent to the <br /> proposed land division or subdivision at least ten <br /> ( 10) days prior to the hearing of the appeal . <br /> • <br /> (E) Within thirty (30) days of the appeal hearing, the <br /> Board shall affirm, modify, or reverse the action of <br /> the Plan Commission or shall refer the matter back <br /> to the Plan Commission for further consideration. <br /> Notice of the decision of the Board shall be sent <br /> to the subdivider and the Plan Commission. <br />
