MINUTES OF THE DANE COUNTY BOARD OF ADJUSTMENT <br /> MEETING OF SEPTEMBER 17, 1971 <br /> The Dane County Board of Adjustment met on September 17, 1971 at 7:30 P.M. <br /> in Room 226 (Circuit Court Branch IV) to conduct a public hearing as <br /> published in the notice. <br /> Present: Erickson, Holte, Dahlk. Also: Enger, Fleck <br /> Meeting was called to order. Motion to approve the minutes of August 20 <br /> and September 11, 1971 by Dahik. Second by Holte, carried. <br /> The notice was read and the public hearing was opened. <br /> v#131. Appeal by Don Simon from denial of a permit to build an addition <br /> to a residence located on lot 13, Block 2 of Country Club Park, Towns`aip <br /> of Dunn. Permit denied because rear yard is less than required <br /> by the Dane County Zoning Ordinance. <br /> IN FAVOR: D. Simon presented drawing of plat and plot plan. Area <br /> was platted before present 50" rear yard requirements. Mr. Enger <br /> stated that he had been trying to convince the townships of Dunn <br /> and Pleasant Springs to re-zone the area to R-3 otherwise there will <br /> be many lots requiring this same type of variance. <br /> OPPOSED: None <br /> TOWN BOARD: Not present <br /> #132. Appeal by Phyllis K. Hubert from denial of a permit to build an <br /> addition to a residence located in the Ni4.4 NE 4 of Section 36, <br /> Township of Fitchburg. Permit denied because side yard is less <br /> than required by the Dane County Zoning Ordinance. <br /> IN FAVOR: Arlan Hubert; this is only feasible location to build <br /> the addition. <br /> OPPOSED: None <br /> TOWN BOARD: Not present <br /> #133. Appeal by Amos Bruflat from denial of a permit to build an addition <br /> to a residence located on a parcel of land in the NW SE 4 of <br /> Section 19, Township of Blue Mounds. Permit denied because setback <br /> from road is less than required by the Dane County Zoning Ordinance. <br /> IN FAVOR: Amos Bruflat; would like enough room to provide a 4' <br /> stairway and a deck for the front entrance to residence. Existing <br /> stairway is hazardous. <br /> OPPOSED: None <br /> TOWN BOARD: Not present <br /> v #1311. Appeal by Leonard Jevne from denial of a permit to build an additior <br /> to a residence located on Lot 10 Assessor's Plat of Fox Bluff, <br /> Township of Westport. Permit denied because rear yard (setback <br /> from water) is less than required by the Dane County Zoning <br /> Ordinance. <br /> IN FAVOR: Warren Kuehling, Attorney, representing L. Jevne stated <br /> that residence was built in 1957 with the idea of adding. the second <br /> story in the future, but through a series of incidents this was <br /> never done. Mr. Jevne began construction upon issuance of his <br /> permit on May 5, 1971. Mr. Enger pointed out that permit was <br /> issued on the basis of information supplied by Mr. Jevne. The <br /> distance from the lake was shown to be 100". Mr. Kuehling stated <br /> I`- that Mr. Jevne had no intention to falsify information and that as <br /> , a builder Mr. Jevne was aware of the ramifications of such an act. <br />
