MINUTES OF THE DANE COUNTY BOARD OF ADJUSTMENT MEETING OF SEPTEMBER 17, 1971 The Dane County Board of Adjustment met on September 17, 1971 at 7:30 P.M. in Room 226 (Circuit Court Branch IV) to conduct a public hearing as published in the notice. Present: Erickson, Holte, Dahlk. Also: Enger, Fleck Meeting was called to order. Motion to approve the minutes of August 20 and September 11, 1971 by Dahik. Second by Holte, carried. The notice was read and the public hearing was opened. v#131. Appeal by Don Simon from denial of a permit to build an addition to a residence located on lot 13, Block 2 of Country Club Park, Towns`aip of Dunn. Permit denied because rear yard is less than required by the Dane County Zoning Ordinance. IN FAVOR: D. Simon presented drawing of plat and plot plan. Area was platted before present 50" rear yard requirements. Mr. Enger stated that he had been trying to convince the townships of Dunn and Pleasant Springs to re-zone the area to R-3 otherwise there will be many lots requiring this same type of variance. OPPOSED: None TOWN BOARD: Not present #132. Appeal by Phyllis K. Hubert from denial of a permit to build an addition to a residence located in the Ni4.4 NE 4 of Section 36, Township of Fitchburg. Permit denied because side yard is less than required by the Dane County Zoning Ordinance. IN FAVOR: Arlan Hubert; this is only feasible location to build the addition. OPPOSED: None TOWN BOARD: Not present #133. Appeal by Amos Bruflat from denial of a permit to build an addition to a residence located on a parcel of land in the NW SE 4 of Section 19, Township of Blue Mounds. Permit denied because setback from road is less than required by the Dane County Zoning Ordinance. IN FAVOR: Amos Bruflat; would like enough room to provide a 4' stairway and a deck for the front entrance to residence. Existing stairway is hazardous. OPPOSED: None TOWN BOARD: Not present v #1311. Appeal by Leonard Jevne from denial of a permit to build an additior to a residence located on Lot 10 Assessor's Plat of Fox Bluff, Township of Westport. Permit denied because rear yard (setback from water) is less than required by the Dane County Zoning Ordinance. IN FAVOR: Warren Kuehling, Attorney, representing L. Jevne stated that residence was built in 1957 with the idea of adding. the second story in the future, but through a series of incidents this was never done. Mr. Jevne began construction upon issuance of his permit on May 5, 1971. Mr. Enger pointed out that permit was issued on the basis of information supplied by Mr. Jevne. The distance from the lake was shown to be 100". Mr. Kuehling stated I`- that Mr. Jevne had no intention to falsify information and that as , a builder Mr. Jevne was aware of the ramifications of such an act.
