BOARD OF ADJUSTMENT MEETING - JULY 18, 1969
The Dane County Board of Adjustment met at 7:30 P.M., July 12, 1969
in Room 226 (Circuit Court Branch IV), City-County Building, Madison
Wisconsin to conduct a public hearing as published in the notice.
The following members were present: Millard Erickson, Chairman;
Oscar Holte, Vice-Chairman; Hermann Eisner, Secretary. Also present;
L. J. Enger, Zoning Assistant
The meeting was called to order; the minutes of the meetings of June
27 and July 12 were adopted. The notice was read and the following
cases heard:
1. Appeal by John F. Way from the denial of a permit to build a gar-
age on lot 8, Lee's Park Subdivision, Town of Pleasant Springs.
Permit denied because set back from road is less than required by the
Dane County Zoning Ordinance.
THOSE IN FAVOR: Mr. Way appeared and showed a plot plan with the lot
size corrected and the garage would have door openings to the road
with a 5 foot set back. The distance from the house would be 14 feet
and could not go any closer because of the septic tank. The garage
would be used primarily for storage of boats, snowmobiles etc.
THOSE OPPOSED: None.
TOWN BOARD: Did not appear.
ACTION BY THE BOARD: Mr. Eisner moved to deny approval, motion lost
for the lack of a second. Mr. Way offered to reduce the depth of the
garage to 20 feet which would make a set back of 9 feet and not put
a door on the street side. Mr. Eisner moved that this variance be
granted, Mr. Holte seconded and the motion carried.
2. Appeal by Merton Stebbins from the denial of a permit to build a
garage on Outlot 40, Assessor's Plat of the Village of Albion, Town
of Albion. Permit denied because set back from state highway is less
than required by the Dane County Zoning Ordinance.
THOSE IN FAVOR: Mr. Stebbins appeared and presented his plans, the
garage will be partly on the foundation of a gas station which was
once on the property. To maintain the required set back from STH 106,
he could not build a garage on his property, since the edge of his
home is at the 100 foot line.
THOSE OPPOSED: None
TOWN BOARD: The Town Board appeared and stated they had no objection.
ACTION BY THE BOARD: Mr. Eisner moved to grant the variance, Mr.
Holte seconded and the motion carried.
Meeting adjourned at 8:15 P.M.
Mileage: All regular
Secretary, Hermann Eisner"&2/29t1/77-1
1
