BOARD OF ADJUSTMENT MEETING - MARCH 28, 1969 <br /> The Dane County Board of Adjustment met at 7:30 P.M., <br /> March 28, 1969 in Room 226 (Circuit Court Branch IV), <br /> City-County Building, Madison, Wisconsin to conduct a <br /> public hearing as published in the notice. The following <br /> members were present: Millard Erickson, Chairman; Oscar <br /> Holte, Vice-Chairman; Hermann Eisner, Secretary. Also <br /> present: L. J. Enger, Zoning Assistant. <br /> The meeting was called to order, the minutes of the meetings <br /> of February 14 and March 22 were adopted. The notice was <br /> read and the following cases heard: <br /> 1. Appeal by Hoff & Lem from the denial of a permit to <br /> build an apartment building on Lot 1 of Southdale Gardens, <br /> Town of Madison. Permit denied because side yard on street <br /> side is less than required by the Dane County Zoning Ord- <br /> inance. <br /> THOSE IN FAVOR: Mr. Charles Lem of Hoff & Lem had a new plot <br /> plan showing a set back or side yard of 20 Meet rather than <br /> the 10 feet originally requested. A discussion of the plot <br /> plan followed and a side yard of 10 feet is required on <br /> the opposite side and they have 13 feet 4 inches. Mr. Enger <br /> suggested that the left side yard be reduced to 10 feet <br /> 4 inches and this would increase the street setback to 23 <br /> feet, which would be only 7 feet less than the 30 feet as <br /> required by ordinance. Mr. Welch of the Welch Building <br /> tor Corporation, owner of adjoining land was in favor of this. <br /> THOSE OPPOSED: None <br /> TOWN BOARD: Mr. Don Pierstorff, Supervisor of the Town of <br /> Madison said that the Town was concerned,' over the access <br /> from the parking areas to the street in the event that the <br /> buildings would be sold individually. The town would like <br /> to see easements put in the deeds so that at some later <br /> time the town would not be caught in the middle of a park- <br /> ing dispute. <br /> ACTION BY THE BOARD: Mr. Eisner moved that the variance of <br /> 23 feet on the side yard be granted subjected to a satisfactory <br /> agreement with the Town of Madison over parking easements. <br /> Mr. Holte seconded and the vote was unanimous. <br /> The meeting was adjourned at 8:00 P.M. <br /> All mileage regular. <br /> Secretary, Hermann Eisner <br />
