BOARD OF ADJUSTMENT MEETING - AUGUST 27, 1968 <br /> The Dane County Board of Adjustment met at 7:30 P.M. on August 27, <br /> 1968 in Room 223, City-County Building, Madison, Wisconsin to conduct <br /> a public hearing as published in the notice. The following members <br /> were present: Millard Erickson, Chairman; Oscar Holte, Vice-Chairman; <br /> Hermann Eisner, Secretary. Also present: Sam Morris, Assistant Corp- <br /> oration Counsel; L. J. Enger, Zoning Assistant. <br /> The meeting was called to order, the notice read and the following <br /> cases heard: <br /> 1. Appeal by Harold Pinger from the denial of a permit to build a <br /> garage on Lot 3 and the E3 of Lot 4, Brictson Park, Town of Dunn. <br /> Permit denied because set back from road is less than required by <br /> Ordinance. (35 feet from c/1 of road, 63 feet required) <br /> THOSE IN FAVOR: No one appeared. <br /> THOSE OPPOSED: Dr. Eugene Schroch asked that such a variance not be <br /> granted since it was not in keeping with the set back of other garages <br /> in the area. <br /> TOWN BOARD: Mr. Edwards and Mr. Hanson asked that a variance not be <br /> granted which would be greater than a 14 foot set back. <br /> ACTION BY THE BOARD: Mr. Eisner moved that the appeal be denied, Mr. <br /> Holte seconded and the vote was unanimous for denial. <br /> 2. Appeal by W. L. Henderson (Home Feed Co., ) from the denial of a <br /> permit to remodel a non-conforming building on Lots 6 and 7, Block <br /> 14, Village of Morrison, Town of Windsor. Permit denied because set- <br /> back from road is less than required by Ordinance. (-1 feet from row <br /> line of road, 20 feet required) <br /> THOSE IN FAVOR: Wm. L. Henderson, manager of Home Feed Co., said the <br /> building was built about 75 years ago for use storage purposes. Home <br /> Feed had used the building for the past 12 years for various purposes <br /> and more recently had remodeled it for the housing of a corn dryer. <br /> The corn dryer operation is a necessary service for the farmers in <br /> the area and a variance for the building will be needed quite soon as <br /> the the corn harvest is not far off. <br /> Mr. Erickson asked what additional work would be required to complete <br /> the building. Mr. Henderson said it was ready to use, but not complete <br /> as planned.and that he had not applied for a permit becquse he didn't <br /> realize they were needed. <br /> Mr. Erickson said as Chairman of The Town of Windsor, he had advised <br /> Mr. Henderson a number of times that both County and Town permits were <br /> needed for any construction work to be done, however there were not <br /> any applications made for such permits and a great deal of work .. :f; <br /> has been done. <br /> Mr. Enger explained to the group the requirements of the Zoning Ord- <br /> inance in regard to a non-conforming building also the interpretation <br /> that had been made that the drying of corn would be a legal use on <br /> land which was zoned C-2 Commercial and Light Manufacturing. <br /> Mr. Morris was of the opinion that these matters were correct in the <br /> interpretation of the Ordinance. <br /> Mr. Eisner asked if there were any alternative plans made in case the <br /> varaince was not granted. Mr. Henderson said that since the building <br /> had been tagged, he had not made any plans to dry corn else where. His <br /> present plans do ant include more drying capacity. <br />
