BOARD OF ADJUSTMENT MEETING - NOVEMBER 7, 1968 <br /> The Dane County Board of Adjustment met at 7:30 P.M., November <br /> 2, 1968 in Room 226 (Circuit Court Branch IV), City-County Build- <br /> ing,°-Madison Wisconsin to conduct a public hearing as published <br /> in the notice. The following members were present: Millard Erickson, <br /> Chairman; Oscar Holte, Vice Chairman; Hermann Eisner, Secretary. <br /> Also present: Glenn Henry, Corporation Counsel; L. J. Enger, Zoning <br /> Assistant; W. G. Massarene, Zoning Supervisor. <br /> The meeting was called to order, the notice read and the following <br /> cases heard: <br /> Appeal by J. E. & R. E. Smithback from the denial of a permit to <br /> build a warehouse on a parcel of land in the SWa NEi of Section <br /> 36, Town of Madison. Permit denied because set back from the road <br /> is less than required by Dane County Zoning Ordinance. <br /> THOSE IN FAVOR: Mr. J. E. Smithback appeared and explained his plans <br /> for a warehouse on the property. To maintain the required set back <br /> would put his building 5 feet behind existing buildings, which are <br /> non-conforming as to set back. This would also make it hard to unload <br /> trucks at the rear of the building. The same set back as existing <br /> buildings (55 feet c/1) was requested. <br /> THOSE OPPOSED: Don Hopke, James V. Thompson, Lee Coyier appeared and <br /> questioned use of the building. The C-2 Zoning was pointed out as <br /> allowing general warehousing. They were not opposed to the 55 feet, <br /> upon questioning by Mr. Eisner. <br /> TOWN BOARD: Harvey Schmidt, Chairman; H. D. Frederick and Don Pierstorff, <br /> Supervisors. Mr. Schmidt said the Town was in favor of granting the <br /> variance. <br /> ACTION BY THE BOARD: Mr. Holte moved, Mr. Erickson seconded and the <br /> motion carried. <br /> Appeal by James R. Kampen from the denial of a permit to build a <br /> tavern on a parcel of land in the SW54 SW',4 of Section 22, Town of <br /> Westport. Petitioner states that an error has been made with re- <br /> spect to the interpretation of the terms of the ordinance in that <br /> through clerical error the amendment of February 17, 1966 as passed <br /> by the Dane County Board of Supervisors did not conform to the <br /> petition presenting said amendment and that the word 'taverns' was <br /> erroneously omitted therefrom. <br /> THOSE IN FAVOR: James R. Kampen and David Meier, attorney appeared <br /> and explained the petition. Mr. Henry said that while it would not <br /> be legal for the Board to grant a zoning variance, in this instance <br /> a variance could be granted to correct a clerical error. <br /> THOSE OPPOSED: None <br /> TOWN BOARA: Jerome Ripp and Bernard Kennedy, superviosrs appeared <br /> and stated that the Town Board was in favor of granting the variance. <br /> ACTION BY THE BOARD: Mr. Holte moved, Mr. Erickson seconded and the <br /> motion carried. <br /> The meeting was adjourned at 8:05 P.M.
