BOARD OF ADJUSTMENT HEARING, <br /> Monday,April 10, 1967 <br /> The following members were present: Chairman, Martin J. Ripp, O. K. <br /> Anderson. <br /> The Hearing was called to order at 7:30 o'clock P. M. by the Chairman <br /> and Mr. Anderson read the notice. <br /> • <br /> 1. This matter was previously withdrawn from consideration by the <br /> applicant. <br /> 2. Appeal from the denial of a permit for a Change in Use and Addition <br /> (apartment building) on lands described as ot 1, the south 28 feet of Lot <br /> 2, Block 1, Gilman and Droster Plat, and u iplatted land in the SEia SAP/4, <br /> Section 23, Town of Burke. Permit denied for the reason that setback from <br /> the R.R. right of way is less than ordinance requirements and also, area <br /> is less than ordinance requirements. The setback from Felland Road was <br /> found to be 50 feet and sufficient upon inspection by the Board. Mr. <br /> Elmer F. Busse, the applicant, appeared and explained that he now agrees <br /> with the Board and is willing to comply with the area requirements for <br /> apartment units subject to the provisions to this particular situation <br /> (5,000 sq. ft./unit). He will probably purchase an acre; he also has now <br /> decided that he wants nine units in all, but may begin with two or three <br /> units at the present. He was advised by mail, by Don Benway, that he would <br /> need a percolation test to comply with the State Board of Health require- <br /> ments and Industrial Commission Approval before a permit could be issued <br /> after the Board of Adjustment granted approval of the only remaihing ob- <br /> jective: Change in use from the Dog Food Plant to a Residential Structure. <br /> It was felt that the insufficient setback, from the R.R. right of way, <br /> allowed at the Hearing on May 2, 1949, should remain as is. <br /> OTHERS IN FAVOR: The Town Board Chairman, Mr. Anderson is on the Committee, <br /> and Jessie W. Droster, and Marvin McCoy were present and registered the <br /> Town Board in favor. <br /> OPPOSSED; none. <br /> 3. Appeal from the denial of a permit for a Silo and Feeder on a parcel <br /> in the SW1I Stan/, Section 3, Town of Medina. Permit denied for the reason <br /> that setback is less than ordinance requirements. Roger Langer, the applicant, <br /> appeared and explained that he wanted to place the new Silo and Feeder in the <br /> only place which would be feasable. Discussion showed that both would be 25 <br /> feet from Canal Road as inspection showed by the Board. There was assurrence <br /> that the silo would be filled from one side rather than the road side and <br /> would not constitute a traffic hazzard. <br /> OTHERS IN FAVOR: The Town Board was represented by Leo Benesch and Leonard <br /> Kuhl and they registered the Board in favor. <br /> OPPOSSED: none. <br /> 4. Appeal from the denial of a permit for an Addition to a Public Garage <br /> on a parcel in the SW14 SW 1/4, Section 27, Town of Roxbury.
