Motion by Voges, secor { by Dahlk to grant special exception to <br /> dr <br /> liow construct a pond as proposed subject to the following conditions: <br /> 1. pond shall have no direct connection with stream tributary. <br /> 2. banks and spoil shall be seeded to prevent erosion. <br /> Dane County Zoning Department shall be notified of completion to <br /> verify compliance. <br /> Motion carried. <br /> #500. Motion by Dahlk, second by Voges to grant special exception <br /> as proposed. Motion carried. <br /> #501. Motion by Voges, second by Dahlk to grant variance of 21 feet <br /> from setback from centerline of Windsor Road as per finding of fact: <br /> 1. existing structure is located too close to road. <br /> 2. other houses in area have porch entries. <br /> 3. other houses in area are located closer to the road. <br /> 4. Addition will not obstruct vision of traffic nor constitute <br /> a hazzard. <br /> CONCLUSION. <br /> A. Proven case of unnecessary hardship. <br /> B. Variance is necessary to provide right enjoyed by others. <br /> C. Variance is not contrary to rights of others or to the public <br /> interest. <br /> Motion carried. <br /> #502. Motion by Dahlk, second by Voges to reluctantly grant a variance <br /> from provision of ordinance providing that there may be only one acces- <br /> sory building on a lot. The Board feels that the Zoning Ordinance should <br /> be amended to provide for accessory buildings with a total square foot <br /> area no larger than 50% of the residence. Variance granted on following <br /> finding of fact: <br /> 1. under present ordinance the building would have to be added to <br /> either the residence or the accessory garage. Due to the terrain of <br /> the lot it would not be feasible to add to the residence. Addition <br /> to the garage would also be on a different grade level causing a <br /> break in roof line. Also, to add to the garage would require tearing <br /> up, cemented in, clothes poles. . <br /> 2. the purpose for the proposed building is for storage of garden <br /> tractor, and equipment plow, disc. etc. addition to garage would <br /> place the storage a considerable distance from the garden area <br /> requiring a line back to the garden which will disrupt lawn and <br /> landscaping. <br /> CONCLUSION : <br /> A. Proven case of unnecessary hardship. <br /> B. Variance is not contrary to rights of others or to the public <br /> interest. <br /> C. Hardship is caused by the ordinance and is not self-imposed. <br /> Motion carried. <br /> C <br />
