-2- 10/3/75 <br /> Minutes Board of Adjustment <br /> 5. Assessment records reveal that there were no assessments for improve- <br /> ments on the land for the year 1969. <br /> 6. Appeal #377 would result in a 100% increase in the living area by <br /> the addition of an upper story. <br /> 7. Appeal #389 requests remodeling and new siding "just-to make live- <br /> able". <br /> 8. Appeal #392 requests new siding and roof repair. <br /> 9. In field inspection by Board of Adjustment disclosed that struc- <br /> tures were in poor condition. <br /> 10. Communication from Dunn Town Board stated their opposition to grant- <br /> ing of the appeals. <br /> 11. Communication from L.J. Enger stating that the granting of any <br /> special exception or variance to improve or enlarge the buildings would <br /> be, in effect, permitting a new building when and where the ordinance <br /> prohibits such a building. <br /> 12. Certified Survey Map #1670, dated 4/29/75 clearly indicates that <br /> the existing structures were non-conforming with respect to flood plain <br /> and building setback from shoreline. <br /> Conclusion: <br /> 1. Based on assessed valuation of structures which was $0.00, at the <br /> time they became non-conforming in 1969, the proposed improvements would <br /> be in excess of 50% of the assessed value and the granting of the <br /> appeals would be, in effect, permitting new buildings which are pro- <br /> hibited by the ordinance. <br /> 2. The structures are totally non-conforming as to use and location, <br /> granting of appeals would be in contradiction to phasing-out intent <br /> of the ordinance and would be contrary to public interest by inde- <br /> finately extending the non-conforming use and permitting possible <br /> expansion of such use with resulting detriment to health conditions. <br /> 3. Denial of appeals is not contrary to rights of the individuals; <br /> the structures were known to be non-conforming when purchased and <br /> may be continued in use as non-conforming under the provisions of the <br /> Dane County Zoning Ordinance. <br /> Motion carried. <br /> Meeting was adjourned. <br /> Harland Dahlk <br /> Secretary <br />
