MINUTES OF THE DANE COUNIY BOARD OF ADJUSTMENT
MEETING OF JANUARY 17, 1975
Present: Erickson, Dahlk, Voges, Also: Enger, Fleck.
Meeting was called to order at 7:30 P.M. by Chairman Dickson to conduct
a Public Hearing as published in the notice. Motion by Dahlk, second
by Voges to approve routes of December 20, 1974; carried. Notion
by Dahlk, second by Voges, to amend the minutes of the last inspection tr' .
to read " meeting of January 11, 1975" and to approve as amended; carried.
The notice was read and the Public Hearing was opened.
#332, R. Trumpy - No present.
#333. Appeal by Donald A. Zellmer for a Special Exception Permit to
construct two ponds adjacent to Spring Valley Creek in the Sai SI♦i4
of Section 35, Township of Primrose. Donald Zel Lmer proposes two farm
ponds adjacent to Spring Valley Creek; will be spring fed with overflow
pipe into creek. Spoil will be used to fill in and reclaim a portion
of marsh land. Working with A.S.C.S. Each pond is approximately
acre.
OTHERS IN FAVOR: none. OPPOSED: none TOWN BOARD: not present.
No communications.
1
#334. Appeal by Howard E. Mazur for a variance from required setback
from road as provided by Section 10.17 (t,.) of the Dane County &iuing
Ordinance. Variance is necessary to permit construction of a residence
on Lot 12, Block 3, Morris Park, Township of Westport. Howard E.
Mazur; variance is necessary because of topography of the lot. There
are problems in locating the septic field which will require the
residence to be as far forward on the lot as possible, even with the
requested 6' setback, a variance will be required from the State
because the field will still be too close to the residence. Other
residences in the area are as close to the road. Question, Dahlk; does
" the garage have to be 30' deep? Mazur; the garage is only 22' deep,
there is a porch entrance, into the residence, behind the garage.
This design is the result of much consideration and planning to acco-
modate the residence on the lot, the garage could not be any smaller,
would not want to build without it. Question, Erickson; is this
residence for speculation or for your own use? Mazur, it is for my own
use, I have an option to purchase the property.
IOTHERS IN FAVOR: none
OPPOSED: Don Jones, owner of adjacent lots 1j, & 14; presented letter
i in opposition from William and Betty Rutenberg. Mr. Jones expressed
concern over the extreme amount of variance necessary. Street is dead-end,
parking for residence to the South is in the street; adding another resi-
dence with no parking available, other than the garage would add to
the problem. Another concern is the septic system; systems in the area
have had problems and this design as proposed does not provide an
alternate field in the event the original one fails.
