MINUTES OF THE DANE COUNTY BOARD OF ADJUSTMENT <br /> MEETING OF JAEUARY 19, 1973 <br /> The Dane County Board of Adjustment met on January 19, 1973 with the <br /> following members present: Erickson, Holte, Dahlk. Also: Enger, Fleck, <br /> Meeting was called to order at 7:30 P.M. in Room 226, City-County Building <br /> to conduct a public hearing as published in the notice. A motion was made <br /> by Holte to approve the minutes of December 15, 1972 and January 13, 1973, <br /> second by Dahlk, Carried. <br /> The notice was read and the public hearing was opened. <br /> #207. Application by Ellward Wolff for a Special Exception permit to <br /> deepen and enlarge an existing pond located on a parcel of land in <br /> the SEA SE% of Section 11, Township of Montrose, <br /> IN FAVOR: E. Wolff - D.N.R. has issued a permit for the proposed <br /> work and S. C. S. has engineered the project. The main purpose is to <br /> provide a water supply in case of fire, secondary use will be farm <br /> pond and fishing. A log jam gate will control pond level. <br /> OTHERS IN FAVOR: none. OPPOSED: none. TOWN BOARD: not present. <br /> #208. Appeal by Roy Simmons from denial of a permit to build an addition to <br /> a residence located on the NE 25' of Lot 1; and Lot 2, Block 1, <br /> Colladay Park, Township of. Dunn. Permit denied because setback from <br /> County Highway and side yard are less than required by the Dane County <br /> Zoning Ordinance. <br /> IN FAVOR: R. Simmons, addition will provide for the garage to be on <br /> same level as residence. Terrain is too steep to permit building in <br /> back of house. <br /> OTHERS IN FAVOR: none. OPPOSED: none. TOWN BOARD: Mrs. Hkbert Pres c <br /> Town Board has no objection. <br /> The public hearing was closed. <br /> #207. Motion by Holte to grant special exception permit as per finding of <br /> fact: 1. The proposed enlargement of an existing pond which is part <br /> of a navigable stream is under the direction of S.C.S. and <br /> a permit has been issued by DNR. <br /> 2. Under the existing conditions the proposed work will not <br /> • result in substantial detriment to the stream by erosion, <br /> sedimentation, impairment of fish or aquatic life or water <br /> pollution. <br /> Second by Dahlk, carried. <br /> #208. Motion by Dahlk to grant variance of 25' from setback requirements <br /> and 6' variance from side yard requirements as per finding of fact: <br /> 1. No other location is useable because of steep slope of <br /> terrain from road to the lake. <br /> 2. Condition is unique; other properties have less severe <br /> slope or adequate level space. <br /> 3. Granting cf variance will not be contrary to public interest <br /> or damaging to rights of other persons or property values <br /> lb, in the area. <br /> Second by Holte, carried. <br /> The meeting was adjourned. <br /> Oscar Holte, <br /> Secretary <br />
