r MINUTES OF THE DANE COUNTY BOARD OF ADJUSTMENT MEETING OF October 19, 1973 (LorPresent: Erickson, Holte, Dahlk. Also: Fleck. Meeting was called to order at 7:30 P.M. in Room 226 to conduct a Public Hearing as published in the notice. Motion by Holte, second by Dahlk to approve minutes of September 21, and October 13, 1973, carried. Notice was read and the Public Hearing was opened. #239. Appeal by Kenneth R. Johnson from denial of a permit to construct a house on Lot 11, South Meadow, Township of Westport. Permit denied because rear yard;is less than required by the Dane County Zoning Ordinanc- . IN FAVOR: Mr. & Mrs. K. Johnson stated error was made by contractor and they presented petitions from neighbors in support of granting the variance. OTHERS IN FAVOR: None. OPPOSED: None. TOWN BOARD: Kennedy, Shepherd, Tierney in favor. Communication from L. J. Enger, Zoning Administrator, in opposition to granting of variance. #240. Appeal by Walter F. Wirth from denial of a permit to remodel a non-conforming building located on a parcel of land in the N4J`4 Mk of Section 34, Township of Vermont. Permit denied because setback from C.T.H. "JG" is less than required by the Dane County Zoning Ordinance. Irbr IN FAVOR: W. F. Wirth presented site plan, had checked with towil and no permits were necessary. Presented statement from Zoning Department signed by L. Popanz stating no permit was necessary if restoration was maintained on existing foundation with no increase in non-conformity. OTHERS IN FAVOR: None. OPPOSED: Kreuger and Thomas, owners of property across JG from site, believe remodeling is a continuation of a past mistake and prolongs the time the building will be non-conforming, also danger to traffic and children on bikes; serious question on septic system because of proximity to stream. TOWN BOARD: Not present. COMMUNICATION: Telephone call, Don Walker, engineer, County Highway Department, no objection if parking is prohibited on road side of building. #241. Appeal by Henry Sproul from denial of a permit to repair or restore a non-conforming building located on a parcel of land in the S SF% Section 14, Township of Rutland. Permit denied because setback from C.T.H. "A" is less than required by the Dane County Zoning Ordinance. IN FAVOR: H. Sproul, hardship is based on one shed being blown down in storm, and this shed is needed to store this year's tobacco crop. The east end of shed will be removed. uuTHERS IN FAVOR: None. Appeal by Wayne Wolf from denial of a permit to build an addition to a non-conforming building located on a parcel of land in the NEi MAI of Section 27, Township of Dane. Permit denied because setback from C.T.H. "P" is less than required by the Dane County Zoning Ordinance. IN FAVOR: W. Wolf, converting to bulk-milk, required milk house must be attached to milk barn.
