MINUTES OF THE DANE COUNTY BOARD OF ADJUSTMENT <br /> MEETING OF JUNE 16, 1972 Page 1 <br /> The Dane County Board of Adjustment met on June 16, 1972 with the following <br /> members present: Erickson, Holte, Dahlk; also Fleck. <br /> • <br /> Meeting was called to order at 7:30 PM in the City-County Building Room 226 <br /> (Circuit Court Branch IV) to conduct a Public Hearing as published in the <br /> notice. Motion made by Dahlk to approve the minutes of April 21, and June <br /> 10, 1972, second by Holte, carried. <br /> The notice was read and the public hearing was opened. <br /> t. #174. Appeal by Jack Hanmerli from denial of a permit for a sign located in <br /> the SW'-:; S;1 of Section 7, Township of Roxbury. Permit denied because <br /> sign is located too close to other signs .and to the intersection of <br /> Highways 12 and 78. <br /> IN FAVOR J. llammerli stated that the signs have been there a very ion? <br /> time and that neighbors feel they should remain to identify the corne <br /> OTHERS IN FAVOR: none OPPOSED: none TOWN BOARD: not present <br /> Discussion followed in regard to the possibility of moving the signs <br /> so that both Storybook Garden and Smith Advertising Co. signs could <br /> comply with the ordinance. <br /> #175. Appeal by Wm. Rutenberg from denial of a permit to build an addition <br /> toa commercial building located on lots 23, 24, 25, 26 Brickson Park <br /> Township of ;•lestport. Permit denied because side yard (setback f rom <br /> water) is less than required by the Dane County Zoning Ordinance. <br /> IN FAVOR: Attorney Bucaida representing Wm Rutenberg presented aerial <br /> photos and site plan. Proposed addition will be used for additional <br /> dining area. Neighbors are in favor as is the Town Board. Any future <br /> use of this facility and property would require a variance from the <br /> Board of Adjustment. <br /> • <br /> OTHERS IN FAVOR: none <br /> OPPOSED: none <br /> TOWN BOARD: B. Kennedy, Chairman, business has been in existence for <br /> a long time believes it belongs there. Bob Shepard Town Board Supervisor <br /> this will not cause any problem with shoreland or floodplain, Mr. <br /> Rutenberg has purchased the two additional lots to provide adequate <br /> room for septic requirements. James Tierney, Town Board Supervisor <br /> this is probably the best lmnown club in Township, should be taken. int. <br /> consideration. <br /> Communication from Ted Lauf, Flood Plain-Shoreland Management Sectio , <br /> D. N. R. expressing objection to granting a variance permitting the <br /> addition to extend beyond the existing building setback,there would <br /> be no objection, if, upon finding of a hardship the addition to the <br /> building were allowed at the existing setback line. <br /> #176. Appeal by Lee Merickfor a Special Exception Permit to widen Spring <br /> Creek and construct a dam on a parcel of land located in the W1 SE4 <br /> of Section 15, Township of Medina. <br /> IN FAVOR: Attorney Gus Harms representing L. Merick presented aerial <br /> photos, plot maps etc. , for study. Mr. Merick chose this 80 acre parcel <br /> because of the creek, intentions were to beautify area , construct <br /> ponds, creating a residential area. Existing pond in question was <br /> constructed assuming there would be no harmful effects to drainage, <br /> property owners upstream, eta, Wm. Zutter, engineer, who was contact.d <br /> by Mr. Merick to verify the work when the question of permits arose, <br /> reported that he saw no harmful effects as the result of pond or dam <br /> these would act as a setteling pond for the siltation of the stream. <br /> Construction is so that normal creek flow can be maintained, the gat: <br /> at the dam may be used to control flow. Question, Erickson; who was <br /> the origional engineer? Atty. Harms; Mr. Merick has had experience <br />
