COMPOSIT REPORT <br /> APPLICATION # — ) 8 7 <br /> •TOWN BOARD COMMENT: <br /> STAFF COMMENTS <br /> REGIONAL PLANNING-C-OMMISSION (RPC) <br /> Petition 5587. This proposed residential rezoning covers the entire area of a 125-acre farm, including two <br /> existing residences along Grandview Road. The division of the property is according to a final judgment of <br /> • the estate. Now the request is to rezone these parcels to allow residential development. <br /> Upon consultation with the Assistant Corporation Counsel, he indicated that the creation of the parcels by this <br /> process does not obligate the county to rezone them for development. <br /> The proposed rezoning is in an agricultural preservation area of the Town of Verona where the relevant policy <br /> is: <br /> • <br /> Non farm residential development by certified survey in those areas with soils not classified as prime <br /> farmland at a density of one lot per 35 contiguous acres owned, with a minimum lot size of two acres <br /> will be considered for rezoning. - <br /> The policy provides for a minimum amount of residential development in agricultural areas. It is <br /> assumed that rezoning would be required for residential construction. <br /> According to the soil map, over half of the area of this farm is rated to have prime soils according to USDA <br /> definitions. The applicant indicates that 50% of the soils are Class I and II (most productive) and 50% are <br /> Class M. The Class III soils are productive, as born out by the applicant's notation that 92% of the land <br /> proposed for rezoning is cropland,primarily corn. There is a small wooded area. <br /> The density policy of one lot per 35 contiguous acres owned would allow up to 4 lots on the less productive <br /> land. However, the two existing residences become non-farm homes and thus account for two of the <br /> allowable lots. Two more would be allowed by policy as non-farm residential lots. <br /> Thus, from a density policy standpoint, four lots would be allowed, not the 14 as proposed in the petition. <br /> This proposal has major conflicts with the adopted policy for this area. <br /> ENVIRONMENTAL HEALTH DEPT.
