I <br /> * <br /> ORDINANCE AMENDMENT NO. 5557 <br /> Amending Section 10.03 relating to Zoning Districts in the Town of <br /> SUN PRAIRIE <br /> The Dane County Board of Supervisors does ordain as follows: That the <br /> Zoning District Maps of the Town of Sun Prairie be amended to include in the <br /> C-1 Commercial and RH-3 Rural Homes District the following described land: <br /> Part of the NE 1/4 SE 1/4 Section 32, Town of Sun Prairie described as follows; <br /> TO C-1 : Beginning at the Northeast corner of said Lot #1 ; thence S 87° 26' 07" <br /> Pest-along the North line of said Lot #1 , 200.09 feet; thence S 00° 49' 48" <br /> East, 604.03 feet; thence N 82° 43' 03" East along the South line of said Lot <br /> #1 , 201 .28 feet; thence N 00° 49' 48" West along the East line of said Lot #1 , <br /> 587.47 feet to the point of beginning. <br /> TO RH-3: commencing at the Northeast corner of said Lot #1 , thence S 87° 26' <br /> 07" West along the North line of said Lot #1 , 200.09 feet to the point of <br /> beginning; thence continue S 87° 26 ' 07" West along the North line of said Lot <br /> #1 , 1118.48 feet; thence S 00° 57 ' 27 ' East, 216.42 feet; thence N 87° 26' 07" <br /> East, 283.00 feet; thence S 00° 57 ' 27" East, 430.30 feet; thence along a curve <br /> to the left with a radius of 22810 feet and a long chord bearing N 83° 23' 18" <br /> East, 534.29 feet along the Northerly right-of-way of CTH TT; thence N 82° 43' <br /> 03" East along the North right-of-way of said CTH TT, 303.96 feet; thence N 00° <br /> 49' 48" West, 604.03 feet to the point of beginning. <br /> CONDITIONAL ZONING <br /> Conditional zoning is hereby imposed pursuant to Section 10.255 (3)(a) 2.(b) of <br /> the Dane County Code of Ordinances. The rezoned area shall be subject to the <br /> following conditions. <br /> DEED RESTRICTION REQUIRED <br /> This amendment will be effective, if within 90 days of its adoption by Dane <br /> County the owner or owners of the land shall record the following restrictions <br /> on said land: <br /> a. Use of the property shall be limited to retail and service uses. <br /> Said restrictions shall run in favor of Dane County and the pertinent Town <br /> Board as well as the owners of land located within 300 feet of the property. <br /> Failure to record the restrictions will cause the rezone to be null and void. <br /> EFFECTIVE DATE: i,!" 109 <br />
