• <br /> ORDINANCE AMENDMENT NO. 5604 <br /> Amending Section 10.03 relating to Zoning Districts in the Town of <br /> PERRY <br /> The Dane County Board of Supervisors does ordain as follows: That the <br /> Zoning District Maps of the Town of Perry be amended to include in the RH-3 <br /> Rural Homes District the following described land: <br /> Part of the S 1/2 NW 1/4 and NE 1/4 SW 1/4 Section 23, Town of Perry described <br /> as follows: Beginning at the center of said Section 23; thence S 86° 08' 56" <br /> West, 683.88 feet; thence N 23° 14' 30" West, 154.22 feet; thence N 06° 20' 35" <br /> West, 632.16 feet to the South right-of-way line of CTH A; thence S 60° 48' 56" <br /> East along said right-of-way line, 92.89 feet; thence N 29° 11' 04' East along <br /> said right-of-way line, 8.00 feet; thence S 58° 38 ' 04" East along said <br /> right-of-way line, 200.14 feet; thence S 68° 48' 09" East along said <br /> right-of-way line, 313.14 feet; thence Easterly, 219.49 feet along said <br /> right-of-way line and the arc of a curve to the left whose radius is 2909.79 <br /> feet and whose chord bears S 67° 27' 24" East, 219.44 feet; thence S 69° 37'04" <br /> East along said right-of-way line, 66.51 feet to the East line of the NW 1/4 of <br /> Section 23; thence S 00° 01' 36" East, 361.06 feet to the point of beginning. <br /> CONDITIONAL, ZONING <br /> Conditional zoning is hereby imposed pursuant to Section 10.255 (3)(a) 2.(b) <br /> of the Dane County Code of Ordinances. The rezoned area shall be subject to <br /> the following conditions. <br /> CERTIFIED SURVEY REQUIRED <br /> The above listed description is intended to describe land for which a <br /> certified survey map will be prepared for approval and recorded. This <br /> amendment will become effective, if within 90 days of its approval by Dane <br /> County, a certified survey map that describes the land to be rezoned is <br /> recorded in the office of the Dane County Register of Deeds. Failure to <br /> record the survey will cause the rezone to be null and void. <br /> DEED RESTRICTION REQUIRED <br /> This amendment will be effective, if within 90 days of its adoption by Dane <br /> County the owner or owners of the land shall record the following restrictions <br /> on said land: <br /> A. Building site location/s shall be approved by the Town Board. <br /> Said restrictions shall run in favor of Dane County and the pertinent Town <br /> Board as well as the owners of land located within the district affected. <br /> Failure to record the restrictions will cause the rezone to be null and void. <br /> EFFECTIVE DATE: <br />
