ORDINANCE AMENDMENT NO. 560' <br /> Amending Section 10.03 relating to Zoning Districts in the Town of <br /> RUTLAND <br /> The Dane County Board of Supervisors does ordain as follows: That the <br /> Zoning District Maps of the Town of Rutland be amended to include in the RH-2 <br /> and RH-4 Agriculture District the following described land: <br /> Part of the W 1/2 NW 1/4 and SE 1/4 NW 1/4 Section 30, Town of Rutland <br /> described as follows: <br /> TO RH-4: Commencing at the West quarter corner of Section 30; thence East <br /> along the centerline of Rutland Road, 1216.74 feet; thence North along the East <br /> line of the W 1/2 NW 1/4, 1774.40 feet the point of beginning; thence West, <br /> 1132.30 feet to the East right-of-way of CTH MM; thence North along said East <br /> line, 170.00 feet; thence West, 10.00 feet; thence North along the East line of <br /> CTH MM, 700.80; thence East, 1116.60 feet to the East line of the W 1/2 NW 1/4; <br /> thence South along said East line, 863.80 feet to the point of beginning. <br /> TO RH-2: Commencing at the West quarter corner of said Section 30; thence East <br /> along the centerline of Rutland Road, 1232.75 feet; thence North, 33.00 feet to <br /> the North line of Rutland Road said point being the point of beginning; thence <br /> West along said North line, 66.00 feet; thence North, 914.90 feet; thence <br /> Westerly, 197.32 feet; thence Northerly, 292.99 feet; thence continuing <br /> Northerly, 237.27 feet; thence Northwesterly, 236.50 feet; thence Northerly, <br /> 122.97 feet; thence East, 400.00 feet to the East line of the W 1/2 NW 1/4; <br /> thence South along said East line, 864.40 feet; thence Easterly, 16.00 feet; <br /> thence South, 875.40 feet to the point of beginning. <br /> CONDITIONAL ZONING <br /> Conditional zoning is hereby imposed pursuant to Section 10.255 (3)(a) 2. (b) <br /> of the Dane County Code of Ordinances. The rezoned area shall be subject to <br /> the following conditions. <br /> CERTIFIED SURVEY REQUIRED <br /> The above listed descriptions are intended to describe land for which a <br /> certified survey map will be prepared for approval and recorded. This <br /> amendment will become effective, if within 90 days of its approval by Dane <br /> County, a certified survey map that describes the land to be rezoned is <br /> recorded in the office of the Dane County Register of Deeds. Failure to <br /> record the survey will cause the rezone to be null and void. <br /> DEED RESTRICTION REQUIRED <br /> This amendment will be effective, if within 90 days of its adoption by Dane <br /> County the owner or owners of the land shall record the following restrictions <br /> on said parcels of land: <br /> A. Division of these parcels is not permitted. <br /> Said restrictions shall run in favor of Dane County and the pertinent Town <br /> Board as well as the owners of land within the district affected. Failure to <br /> record the restrictions will cause the rezone to be null and void. <br /> EFFECTIVE DATE• <br />
