This zoning petition was filed by
Mr. Donald L. Paulson, a surveyor for the developers, as agent for my clients. It was
only after the rezoning notice was forwarded to my clients that I learned that Mr.
Paulson had included within the proposed rezoning the remnant parcel consisting of
approximately 3.5 acres to be retained by my clients. After learning of this, I reviewed
the zoning ordinances and discussed this matter with Mr. Reynolds to verify that R-2
zoning would be inappropriate (given the number of outbuildings on the remnant
parcel which my clients wish to retain), and further, that leaving the property in its
current zoning classification, A-1, would be inappropriate since the remnant parcel
was not at least five acres.
Accordingly, after discussion with Mr. Reynolds, it was suggested that the most
appropriate solution would be to rezone the Rosenberry remnant parcel to RH-1 rural
homes district. After discussing this matter with my clients, they are in agreement
with this approach. Therefore, please treat this letter as authorization and consent on
behalf of my clients to an amendment of Zoning Petition No. 5605 to remove the
remnant Rosenberry property from the proposal to rezone to R-2 and instead rezone
the parcel to RH-1.
For your information, please find enclosed a metes and bounds description of the
property to be rezoned, by amendment, to RH-1, together with a copy of the relevant
portion of the proposed plat which shows the location of the remnant parcel to be
