ORDINANCE AMENDMENT NO. 5605 <br /> Amending Section 10.03 relating to Zoning Districts in the Town of <br /> WINDSOR <br /> The Dane County Board of Supervisors does ordain as follows: That the <br /> Zoning District Maps of the Town of Windsor be amended to include in the R-2 <br /> Residential and RH-1 Rural Homes Districts the following described land: <br /> TO R-2: Part of the E 1/2 NE 1/4 Section 30, Town of Windsor described as <br /> follows: Beginning at the Southeast corner of said NE 1/4 of Section 30; <br /> thence S 89° 31' 47" West, 935.64 feet; thence N 01° 17' 33" West, 433.00 feet; <br /> thence S 89° 31' 47" West, 388.00 feet; thence N 01° 17' 33" West, 933.05 feet; <br /> to the Southwest corner of the said Lot #1, Certified Survey Map #6322; thence <br /> N 89° 47' 37" East, 230.43 feet; thence N 00° 34' 14" West, 80.00 feet; thence <br /> N 27° 44' 28" East, 110.95 feet; thence N 65° 59' 46" East, 517.72 feet; thence <br /> S 87° 24' 44" East, 116.00 feet; thence S 72° 26' 56" East, 469.67 feet to the <br /> centerline of Lake Road and the East line of the said NE 1/4; thence along the <br /> East line of the said NE 1/4, S O1° 18' 33" East, 1598.02 feet to the point of <br /> beginning. <br /> TO RH-1: Commencing at the Southeast corner of said NE 1/4 of Section 30; <br /> thence S 89° 31' 47" West, 935.64 feet to the point of beginning; thence <br /> continuing S 89° 31' 47" West, 388.00 feet; thence N 01° 17' 33" West, 433.00 <br /> feet; thence N 89° 31' 47" East, 388.00 feet; thence S 01° 17' 33" East, 433.00 <br /> feet to the point of beginning. <br /> CONDITIONAL ZONING <br /> Conditional zoning is hereby imposed pursuant to Section 10.255 (3)(a) 2.(b) <br /> of the Dane County Code of Ordinances. The rezoned area shall be subject to <br /> the following conditions. <br /> RECORDING OF PLAT REQUIRED <br /> The above listed descriptions are intended to describe land for which a <br /> subdivision plat will be prepared for approval and recorded. This amendment <br /> will become effective, if within 2 years of its approval by Dane County, a <br /> final plat for the entire area or plats for specific partial areas are <br /> recorded with the Dane County Register of Deeds, the zoning shall be effective <br /> on only the area of the specific plat recorded. Failure to record the plat/s <br /> will cause the rezone to be null and void. <br /> DECLARATION REQUIRED <br /> This amendment will be effective, if within 2 years of its adoption by Dane <br /> County the owner or owners of the land shall record with the Dane County <br /> Register of Deeds a disclosure statement which shall be included in the <br /> subdivision covenants or title documents for each property and which states as <br /> follows: <br /> "This property is located approximatly four miles from the Dane County <br /> Regional Airport and lies under the final instrument approach course to the <br /> primary commercial aircraft Runway #18. Arriving and departing aircraft <br /> will frequently overfly this property" <br /> Failure to record the declaration will cause the rezone to be null and void. <br /> EFFECTIVE DATE: <br />
