• <br /> • <br /> • <br /> • <br /> 22473:1 <br /> AGREEMENT V','L 15455 PAGE 38 <br /> RE: A part of Lot 1, Certified Survey Map Number 6322, <br /> recorded in Volume 30 of Surveys, pages 297 and 298, <br /> as Document Number 2246249, Town of Windsor, Dane <br /> County, Wisconsin, more particularly described as <br /> follows: <br /> Beginning at the Southwest corner of Lot 5 of the Plat <br /> of Hidden Springs located in said NE 1/4 of the NE 1/4 <br /> of Section 30; thence S 0°14'01" E, 399.92 feet; <br /> thence S 89°45'59" W, 66.00 feet; thence N 0°14'01" W. <br /> 399.92 feet to the Southeast corner of Lot 6 of said <br /> Plat of Hidden Springs; thence N 89°45'59" E, 66.00 <br /> feet to the point of beginning. <br /> AGREEMENT made this 21st day of February 1991, by and <br /> • between Howard J. Rosenberry and Margaret K. Rosenberry <br /> (hereinafter referred to as "Rosenberry") and James P. <br /> Steuerwald and Linda M. Steuerwald (hereinafter referred to as <br /> "Steuerwald"), <br /> W I T N E S S E T H : <br /> WHEREAS, on February 21, 1991, Steuerwald purchased from <br /> • <br /> Rosenberry Lot 1 of Certified Survey Map Number 6322; and <br /> WHEREAS, as part of the transaction by which Steuerwald <br /> purchased Lot 1, it was agreed that at any time in the future <br /> Rosenberry may reacquire the referenced real estate for future <br /> development and establishment of a public road thereon; and <br /> WHEREAS, as part of the transaction by which Steuerwald <br /> purchased Lot 1, it was further agreed that Rosenberry be given <br /> a perpetual easement over, under and upon a portion of Lot 1 <br /> allowing Rosenberry to hook into any future sewer line in the <br /> utility sewer easement as shown on Certified Survey Map 6322; <br /> and <br /> WHEREAS, the parties wish to reduce to writing their <br /> understanding with respect to the reacquisition and perpetual <br /> sewer easement of said real estate in the future by Rosenberry; <br /> NOW, THEREFORE, FOR GOOD AND VALUABLE CONSIDERATION, the <br /> receipt and sufficiency of which is hereby acknowledged by and <br /> between the parties, the parties hereto do hereby covenant and <br /> agree as follows: <br /> 1. That this Agreement is part of the consideration by <br /> and between the parties in connection with the sale of Lot 1 by <br /> Rosenberry to Steuerwald. <br /> • <br />
