BOARD OF ADJUSTMENT - Minutes <br /> December 20, 1979 <br /> Page 5 <br /> tir <br /> Public Hearing - Appeal #856 <br /> Appeal by CAP (Citizens' Against the Purchase of St. Joseph's Seminary by <br /> the Division of Corrections, Incorporated) represented by Attorney Myron <br /> Cherry; Assistant Attorney General, Charles A. Bleck, representing the <br /> State of Wisconsin and Attorney Rex Capwell, representing the landowner <br /> involved, St. Joseph's College of Edgerton. <br /> This is an appeal from an alleged decision of the Zoning Administrator <br /> interpreting Section 10. 12 (4) (b) , Dane County Ordinances, to allow <br /> prisons as a conditional use in the A-1 Exclusive Agriculture District. <br /> A request by Mr. Bleck that Chairman Dahlk remove himself from the pro- <br /> ceedings, DENIED. Upon a motion by Purcell, second by Voges and carried <br /> unanimously. Request by Mr. Bleck to dismiss this appeal on the ground <br /> that (1) CAP is not an aggrieved person, (2) that there has been no <br /> decision or order by the Zoning Administrator which is subject to review <br /> by this Board, (3) that the Zoning Committee has exclusive jurisdiction <br /> to determine whether a correctional institution is permitted in an A-1 <br /> Exclusive Agricultural District as a conditional use, and (4) that Attorne <br /> Cherry is not licensed to practice law in the State. Request DENIED, upon <br /> motion by Voges, second by Krushchke and adopted unanimously. <br /> On the main issue of whether or not prisons are a conditional use in the <br /> A-1 Exclusive Agricultural District, other appearances in favor of the <br /> appeal were by Neils Hoegh Gulberg on behalf of the Town Board of Albion; <br /> Ann Vance; George Sadelik; S. A. Jana; Richard Lokken and Sharon Jenson. <br /> State Representative Harland Everson also appeared. Motion by Schwahn, <br /> second by Krushchke, to sustain Appeal #856 carried unanimously. In <br /> sustaining this Appeal, the Board made the following FINDINGS OF FACT: <br /> 1. The lands in question are located in the Town of Albion, are <br /> zoned A-1 Exclusive Agricultural and are presently used for non- <br /> agricultural purposes, having been so used for the last 20 years. <br /> 2. That the Zoning Administrator determined that prisons are a <br /> conditional use in the A-1 Exclusive Agricultural District, such <br /> determination having been made on or about the 9th day of October, <br /> 1979. <br /> 3. That the Appellants here, CAP, filed this Appeal on the 27th <br /> day of November, 1979; that no <br /> Y question has been raised regarding <br /> the timeliness of this Appeal. <br /> 4. That CAP is an organization of persons opposed to the conversion <br /> of St. Joseph's Seminary to a prison and that some of the members <br /> of this organization are landowners in the Town of Albion in the <br /> immediate area of St. Joseph's Academy. <br /> - 5 - <br />
