Appeal by Fred Hornkohl for a variance from required setback and
rear yard as provided by Section 10.17 (4) (b) and 10.14 (7) (a) - Dane
County Zoning Ordinance. Variances are necessary to permit construction
of a building on Lot #3, Block #7, Warner's Addition, Village of Windsor
in Section 29, Town of Windsor.
IN FAVOR: Susan Pothast Hornkohl OPPOSED: Ken Fahey, Bill King, Lyle
Huddleston, petition with 42 signatures presented. TOWN BOARD: Telephone
call from town chairman Morris Cooper; requested that decision be held
in abeyance to allow time for the town to resolve its concerns.
#826. Appeal by Walter Olson Realty for a variance from minimum lot area
and required parking as provided by Section 10.08 (5) (b) and 10.18 (4)
(b) - Dane County Zoning Ordinance. Variances are necessary to permit
reduced lot area and parking for a senior citizen housing project at 5810
C.T.H. "BB" in the SE 1/4 NW 1/4 - Section 11, Town of Blooming Grove.
IN FAVOR: W. Olson OPPOSED: None TOWN BOARD: Wm. Voges, Supervisor;
no recommendation.
#827. Appeal by Rowan Hollis for a variance from required setback from
road as provided by Section 10.17 (3) - Dane County Zoning Ordinance.
Variance is necessary to permit construction of an addition to tavern at
6925 Elder Lane in the SE 1/4 SE 1/4 of Section 22, Town of Bristol.
(11. IN FAVOR: R. Hollis OPPOSED: Francis Green TOWN BOARD: Not present.
#814. Re-called - no appearances.
The public hearing was closed.
#813. Motion by Voges, second by Schwahn to grant a variance of 2,735
square feet from required lot area.
FINDING OF FACT:
1. Re-aligned, new lots will have the same area as the existing lots.
2. Other properties inthe area have been granted a similar variance.
3. This area is part of an older plat, many lots are equal or less
in area. Required minimum shoreland area will not provide protec-
tion as damage has already been done.
CONCLUSION:
a. Proven case of unnecessary hardship.
b. Variance is necessary to provide right enjoyed by others.
c. Variance is not contrary to rights of others or to the public
interest.
Motion carried.
#814. Motion by Purcell, second by Voges to grant a variance of 23 feet
from the required setback from the center of Pine Hill Road. Said
variance shall be subject to Town Board approval.
FINDING OF FACT:
1. Other location of barn would prevent utilization of existing silos
feeders, etc. .
2. Drainage swale or gulley to the South prevents barn from being
located farther back from the road.
