MINUTES BOARD OF ADJUSTMENT <br /> Meeting of August 23, 1979 <br /> PRESENT: Voges Dahlk, Schwahn, Krushchke, Purcell <br /> ALSO PRESENT: Enger, Fleck. <br /> The meeting was called to order by Chairman Dahlk at 7:30 p.m. in Room <br /> #225 City-County Building. Motion by Voges second by Krushcke to <br /> approve the minutes of July 26, August 9 and August 21, 1979. Motion <br /> carried. <br /> The notice was read and the public hearing was opened. <br /> #807. IN FAVOR: Harry and Helen Harnack; Mrs. Elliot. OPPOSED: None <br /> TOWN BOARD: Telephone call from clerk, letter to follow, Board is in <br /> favor. COMMUNICATION: Letters from Nelsons and Waldens in favor. <br /> #808. No appearance. <br /> #809. IN FAVOR: R. Olson; Mary Lou Olson OPPOSED: None TOWN BOARD: <br /> Telephone call from Clerk, letter to follow, Board is in favor. <br /> COMMUNICATION: Letter from Dr. F. Peterson, opposed. <br /> #810. Enger presented zoning permit facts. <br /> COMMUNICATION: Letter from Dane County Highway - opposed. <br /> #808. IN FAVOR: Bill Walden OPPOSED: None TOWN BOARD: Not present <br /> COMMUNICATION: None. <br /> The public hearing was closed. <br /> #807. Motion by Voges, second by Purcell to grant a variance of 9 feet <br /> from required setback from normal high waterline. <br /> FINDING OF FACT: <br /> 1. Many residences in this area have decks, enclosed porches, etc. <br /> which are as close or closer to the lake than the proposed deck. <br /> 2. Strict enforcement of shoreland setback on minority of lots in <br /> this area will not provide the intended protection of the lake. <br /> CONCLUSION: <br /> Variance is required to provide a right enjoyed by others. <br /> Motion carried. <br /> #808. Motion by Krushchke second by Voges to grant a variance of 1 foot <br /> 6 inches from required left side yard. <br />
